On behalf of the Politburo, Standing member of the Secretariat Tran Cam Tu has just signed and issued Regulation 264 amending and supplementing a number of articles of Regulation No. 69/2022 of the Politburo on disciplining party organizations and party members who violate the law.
According to regulation 264, the Politburo decided to amend and supplement a number of articles in regulation 69.
Specifically, amend and supplement the provisions on aggravating circumstances of disciplinary action. Change it to knowing but failing to prevent, or allowing cadres and party members under their direct management to commit corruption, waste, and negativity causing serious consequences.
Compared with the previous regulation, the new regulation adds additional content on violations of waste.
Similarly, regulation 264 also amends and adds content on violations of waste to many regulations.
In which, at point e, clause 2, article 11 (violations of organizational work, cadres and party members' work) it becomes "covering up, not handling, handling improperly or not recommending handling of party members who have acts of seeking positions, power, corruption, waste, negativity, using illegal diplomas, certificates, certificates, and confirmations".
Add more regulations on handling waste
The name of Article 17, from "violation of regulations on preventing and combating corruption and negativity" is also amended and supplemented to "violation of regulations on preventing and combating corruption, waste and negativity".
Points b and c, Clause 1, Article 17 are also amended and supplemented to "b, not leading, directing, urging, inspecting, and supervising lower-level Party organizations and cadres and Party members to implement Party regulations and State laws on preventing and combating corruption, waste, and negativity as prescribed.
Lax leadership and management; lack of inspection and supervision to promptly detect and handle corruption, waste and negativity in party organizations, agencies and units".
The Regulation also states the amendment and supplement to points a, b, c, d, dd, Clause 2, Article 17.
Amended to: do not handle, cover up, or tolerate organizations and individuals who are corrupt, wasteful, negative, or violate regulations on declaration, disclosure, and control of assets and income.
Issue resolutions, directives, and regulations of one's level on preventing and combating corruption, waste, and negativity contrary to the Party's policies and regulations and the State's laws.
Do not handle corruption, waste, and negative behavior in agencies, units, and localities directly managed.
Do not lead, direct or obstruct the recovery of corrupt, wasteful or negative money and assets.
Directing internal or administrative handling of individuals who are corrupt, wasteful, or negative and show signs of crime.
At points a and b of clause 3, article 17 is also amended as follows: violating one of the following cases, causing particularly serious consequences, the disciplinary action is in the form of dissolution:
Issue resolutions and decisions against the Party's policies and regulations and the State's laws in preventing and combating corruption, waste and negativity.
Taking advantage of the prevention and fight against corruption, waste and negativity to distort and cause political and social instability; organized corruption.
The new regulation of the Politburo also amends and adds the word "waste" to Article 39 and changes the name of this article to: "Violation of regulations on preventing and combating corruption, waste, and negativity". Add "waste" to specific points and clauses of this article.
