Charged with death penalty, former Deputy Prime Minister's Assistant has 2 lawyers

The Hanoi People's Court has just issued a decision to hold a first-instance trial for 54 defendants in the case related to the "rescue flight".

According to the decision, the trial is scheduled to open on July 11 and last for one month. The trial panel has five members, including two judges and three people's assessors, chaired by judge Vu Quang Huy.

5 prosecutors representing the Hanoi People's Procuracy were assigned to exercise the right to prosecute and supervise the trial.

Notably, to serve the trial, nearly 100 individuals and legal entities were summoned by the court, including victims, witnesses and related persons.

In this case, 54 defendants were prosecuted for the crimes of: bribery, bribery acceptance, bribery brokerage, abuse of position and power in performing official duties, and fraud to appropriate property.

Among them, defendant To Anh Dung, former Deputy Minister of Foreign Affairs, and defendant Nguyen Quang Linh, former Assistant to the Deputy Prime Minister, were both accused of accepting bribes.

When brought to trial, Mr. Dung had 3 defense lawyers, Mr. Linh had 2 defense lawyers.

According to the indictment, when the Covid-19 epidemic broke out, the Government directed the organization of flights to bring Vietnamese citizens from abroad back to the country. The organization of the flights was assigned to the Government Office and working groups of several ministries and branches.

During the process of granting flight permits and approving local quarantine, from September 2020 to December 2022, 25 individuals who are officials of ministries, branches and localities received bribes totaling nearly 165 billion VND; taking advantage of their positions and powers while performing official duties caused a loss of nearly 10.5 billion VND. 23 individuals representing enterprises gave bribes totaling nearly 227 billion VND, 4 individuals brokered bribes totaling nearly 74.5 billion VND and defrauded more than 24.5 billion VND.

Among the above, defendant Nguyen Quang Linh, former Assistant to the Deputy Prime Minister, received bribes 5 times, with a total of more than 4.2 billion VND.

Defendant To Anh Dung, former Deputy Minister of Foreign Affairs, received bribes 37 times, with a total of 21.5 billion VND.

Defendant Nguyen Thi Huong Lan, former Director of the Consular Department (Ministry of Foreign Affairs), received bribes 32 times, with a total of more than 25 billion VND.

In addition, defendant Pham Trung Kien, former Secretary of Deputy Minister of Health Do Xuan Tuyen, received bribes 253 times, with a total of more than 42.6 billion VND.

Defendant Chu Xuan Dung, former Vice Chairman of Hanoi People's Committee, received bribes 7 times, with a total of more than 2 billion VND.

Defendant Tran Van Tan, former Vice Chairman of Quang Nam Provincial People's Committee, received bribes 9 times, with a total of 5 billion VND...

These defendants were all prosecuted for bribery, according to Point a, Clause 4, Article 354 of the 2015 Penal Code (amended in 2017), with a penalty of 20 years in prison, life imprisonment or death penalty.

According to the prosecutor, this is an especially serious case, occurring in the midst of the tense Covid-19 pandemic. The defendants took advantage of the epidemic, disregarding regulations to make profits, causing Vietnam's reputation to decline.
