The Government has just issued Decree No. 18/2025/ND-CP detailing a number of articles of the Electricity Law related to electricity trading activities and situations of ensuring electricity supply.
Providing more specific information about this Decree, the Electricity Regulatory Authority (Ministry of Industry and Trade) said that according to the Decree, for the purchase and sale of electricity for domestic use, the electricity seller shall record the electricity meter reading once a month on a fixed date agreed upon by both parties in the electricity purchase and sale contract, except in cases of force majeure that pose a risk to the safety of workers as specified in the electricity purchase and sale contract. It is allowed to move the time of recording the electricity meter reading one day before or after the fixed date or move it as agreed upon in the electricity purchase and sale contract.
For the purchase and sale of electricity for non-domestic use, the buyer and seller are allowed to agree on the number of times the electricity meter is recorded per month. In case the two parties cannot reach an agreement, the recording of the electricity meter is regulated based on the average electricity consumption registered in the electricity purchase and sale contract as follows:
Under 50,000 kWh/month, record the index once a month; From 50,000 to 100,000 kWh/month, record the index twice a month; Over 100,000 kWh/month, record the index three times a month.
In case the average actual electricity consumption of the electricity buyer for non-domestic purposes in the last three months exceeds or is lower than the consumption thresholds corresponding to the number of times the index is recorded according to the provisions in points a, b, c above, the electricity seller and the electricity buyer have the right to agree to adjust the number of times the electricity index is recorded.
For electricity buyers using less than 15 kWh/month, the electricity metering cycle is agreed upon by both parties.
For wholesale electricity trading, the recording of electricity meter readings is agreed upon by both parties in the contract. The electricity seller must ensure the accuracy of the recorded electricity meter readings.
