The Standing Committee of Hai Duong Provincial Party Committee requested to clarify collective and individual responsibilities for violations of irrigation works.

Comrade Tran Duc Thang, Member of the Party Central Committee, Secretary of Hai Duong Provincial Party Committee, inspected the handling of violations of provincial road 396 and Dai Phu Giang canal in Ninh Giang district.

The Standing Committee of the Hai Duong Provincial Party Committee has just announced the conclusion on the progress and results of handling violations of irrigation works in the province. Accordingly, the Standing Committee of the Provincial Party Committee basically agrees with the report of the Party Committee of the Provincial People's Committee on the progress, results of handling and solutions to handle violations of irrigation works in the past time.

To strengthen prevention and speed up the handling of violations of the law within the scope of protection of irrigation works in the province, the Standing Committee of the Provincial Party Committee requested the Party Committee of the Provincial People's Committee to coordinate with the Supervision Delegation of the Provincial People's Council to review data, identify violations to classify and handle according to regulations.

Continue to strictly implement Notice No. 1268-TB/TU dated November 24, 2023 of the Provincial Party Standing Committee on handling violations within the scope of protection of intra-field irrigation works. Every 6 months (in June and December every year), report to the Provincial Party Standing Committee on the situation, progress, and results of handling violations of irrigation works in the province. In which, promptly report difficulties, problems and propose plans and solutions to speed up the progress of handling violations.

Request the Standing Committees of district, town and city Party Committees to direct the organization of reviews, clarify the responsibilities of collectives, individuals and heads of relevant agencies, units and localities, and report to the Standing Committee of the Provincial Party Committee on the implementation results in June 2024.

The Standing Committee of Nam Sach District Party Committee and the Standing Committee of Thanh Ha District Party Committee seriously reviewed and learned from the slow implementation of Conclusion Notice No. 1268-TB/TU dated November 24, 2023 of the Standing Committee of the Provincial Party Committee.

According to the report of the Party Committee of the Provincial People's Committee, from the beginning of 2024 to April 26, Hai Duong had 46 violations of irrigation works, of which 7 cases were handled and cleared. Ninh Giang district had the most violations with 11, Gia Loc 9, Tu Ky 5; Thanh Mien, Thanh Ha, Kim Thanh districts each had 4 cases; Hai Duong city had 3 cases, Cam Giang 3, Binh Giang 2 and Nam Sach 1. The main violations were building temporary houses, solid houses, tents, leveling, encroachment, building surrounding walls, digging ponds, setting up gardens...

Up to now, Hai Duong has handled and cleared 616 violations of irrigation works that existed from previous years, of which 355 cases were handled and cleared by local authorities (Binh Giang handled 174 cases, Ninh Giang 141 cases and Tu Ky 40 cases); the rest were self-cleared or cleared when implementing construction projects invested by the state budget, residential projects, urban areas, industrial clusters related to canals.

The province still has a total of 2,250 violations that need to be handled and cleared, including 1,051 violations before July 1, 2018 (the effective date of the Law on Irrigation) and 1,199 violations from July 1, 2018 to present. 1,422 cases are considered to maintain the status quo according to Article 48 of the Law on Irrigation because they do not affect the safety and service capacity of irrigation works. The time to complete handling of existing violations is before December 31, 2024.

The Party Committee of the Provincial People's Committee assessed that the leadership and direction in handling violations of irrigation works from the provincial to district and commune levels in recent times has been basically timely. Departments, branches, localities and units have actively participated, issued directive documents, developed plans to propagate and mobilize self-clearance of violations; developed plans to handle and clear backlog violations; detected and prevented new violations from arising.

Some districts have done well, such as Ninh Giang, Binh Giang, and Tu Ky. However, Thanh Ha and Nam Sach districts have not yet developed a plan to implement handling of violations; some localities still allow new violations to arise.
