According to the report of the People's Committee of Ba Ria - Vung Tau province, the total budget for implementing the policy to provide additional support for the arrangement and streamlining of the provincial apparatus is expected to be drawn from the provincial budget.


On December 12, the People's Committee of Ba Ria - Vung Tau province publicly solicited comments on the draft submission and draft resolution of the Provincial People's Council stipulating additional support policies for cadres, civil servants, public employees and workers in the implementation of organizational restructuring of administrative apparatus and units in the province.

Time for collecting comments on draft submissions and draft resolutions is from February 12 to 14.

Accordingly, on December 31, 2024, the Government issued Decree No. 178/2024/ND-CP on regimes and policies for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system, effective from January 1.

Decree 178 states that, based on the ability to balance the local budget, the People's Council at the same level must issue additional support policies for the subjects.

Based on that, the People's Committee of Ba Ria - Vung Tau province has developed a resolution stipulating additional support policies for cadres, civil servants, public employees and workers in the implementation of organizational restructuring of administrative apparatus and units in the province. It is expected that the draft resolution will be submitted at the thematic session (Session 26).

According to the draft resolution, additional support policies include: Policies for people who quit their jobs (retirement and resignation); policies for people who quit their leadership or management positions or are elected or appointed to lower leadership or management positions; policies to increase business trips to the grassroots level at agencies, organizations, and units during the process of reorganizing the apparatus and administrative units at all levels of the provincial political system.

Subjects of application as prescribed in Points a, b, c, Clause 1, Article 2 of Decree No. 178; Cadres, civil servants, and public employees at provincial-level agencies and units implementing organizational structure arrangement are assigned by competent authorities to work on a 3-year basis at the grassroots level; Agencies, units, organizations, and individuals related to the management of cadres, civil servants, and public employees.

The Resolution stipulates 3 cases of support. Specifically, for cases of early retirement and immediate termination of employment as prescribed in Articles 7, 9 and 10 of Decree No. 178: Additional support will be provided one time equal to 50% of the total subsidy that this subject is entitled to.

Case 2: For cadres, civil servants, and public employees who are leaders or managers and cease to hold leadership or management positions or are elected or appointed to lower leadership or management positions due to organizational restructuring as prescribed in Article 11 of Decree No. 178: They will be supported with an additional 1-time allowance for the old leadership position until the end of the election term or appointment term. In case they have held a leadership or management position for the election term or appointment term with less than 6 months remaining, they will be reserved for 6 months.

For cadres, civil servants and public employees who are required to go on business trips to the grassroots level as prescribed in Article 12 of Decree No. 178: Receive one-time additional support equal to 20 months of basic salary.

According to the report of the Provincial People's Committee, the total estimated cost of implementing the province's additional support policy is about 322 billion VND from the implementation budget guaranteed from the provincial budget.

This Resolution does not apply to the following subjects: Employees (civil servants and labor contracts) not receiving salaries from the State budget at public service units for which the State budget ensures a part of regular expenses. Employees (managerial civil servants, civil servants and labor contracts) at public service units that ensure their own regular expenses and investment expenses; public service units that ensure their own regular expenses.
