According to 9to5Mac , the ban on the sale of the Apple Watch Series 9 and Ultra 2 will cause these products to disappear from Apple's online store from December 21 and the Apple Store from December 24. The ban is said to be related to a patent war between Apple and Masimo - a California company specializing in the production of non-invasive medical sensors. The two companies have been in a patent dispute for some time regarding the rights to some of the Apple Watch's sensors.
The ban affects the latest Apple Watch models from Apple
The crux of the issue is the blood oxygen sensor in these watches, which Masimo believes Apple has infringed on its patent. Since the Apple Watch SE doesn’t have that sensor, it’s not affected by this lawsuit and can continue to be sold without issue. It also doesn’t affect watches from other brands.
“Apple teams work tirelessly to create products and services that support users with industry-leading safety, health, and fitness features,” Apple said in a statement. “Apple strongly disagrees with this order and is exploring a variety of legal and technical options to ensure Apple Watch is available to customers. If the order is upheld, Apple will continue to take all necessary steps to return Apple Watch Series 9 and Apple Watch Ultra 2 models to customers in the US as soon as possible.”
For his part, Masimo CEO Joe Kiani praised the ruling and said it made things clear. In October, the CEO said that “even the biggest companies in the world are not above the law.” At that time, Masimo also tried to seek an injunction against the sale of the Apple Watch Series 6 but was unsuccessful.
This would significantly impact Apple's sales during the crucial Christmas season. However, there is a glimmer of hope for Apple as President Joe Biden could exercise his veto power by December 25th. If that happens, Apple could continue selling the watch as if nothing happened.
