(Dan Tri) - Circular 29 on extra teaching and learning with many new points officially took effect from February 14.
Circular 29/2024/TT-BGDDT, on extra teaching and learning, issued by the Ministry of Education and Training on December 30, 2024, effective from February 14, with 6 new points. (See the full text of Circular 29 regulating extra teaching and learning HERE).
Firstly , according to Circular 29, only 3 cases are allowed to teach extra in schools: excellent students, students with unsatisfactory results and final year students.
Second, extra teaching and learning in schools are not allowed to collect money. It can be seen that, under the old regulations, extra teaching in schools is allowed to collect money and the amount of money is agreed upon between the parents and the school.
But under the new regulations, extra teaching in schools is completely free.

Third , outside of school, teachers who want to teach extra classes must register their business and are not allowed to teach extra classes for money to regular students, whether at home or at a center.
Organizations and individuals that organize extra teaching and learning outside of school and collect money from students must register their business to be subject to management according to the provisions of the Enterprise Law.
The fourth new point, according to the provisions of Circular 29, extra teaching is an additional teaching activity, contributing to consolidating and improving knowledge, skills, and educating students' personality; suitable for psychological characteristics and not causing a situation beyond the learner's ability to absorb.
Fifth, teachers who teach extra classes outside of school must report to the principal or head of the educational institution, while the old circular did not clearly state whether teachers who teach extra classes outside of school need permission from the head or not.
The sixth new point that Circular 29 provides is more clearly the regulation on the taxable income from extra teaching.
Specifically, Clause 2, Article 7 of the Law on Management of collection of tuition fees for extra-curricular teaching and learning stipulates: The level of tuition fees for extra-curricular teaching outside of school is agreed upon between the student's parents, the student and the tutoring facility.
The collection, management and use of tuition fees shall comply with the provisions of the law on finance, assets, accounting, taxes and other relevant regulations.

According to some experts, an education system without extra teaching and learning is the dream of every country. However, the reality shows that extra teaching and learning still exists in our country, for many different reasons.
Many opinions say that part of the reason comes from teachers' income, forcing them to teach extra classes to improve their lives. To solve the negative aspects of extra teaching and learning, can we blame the teachers entirely or must we truly admit: It is a need of both sides?
If the school teaches with enough quality, parents do not need to send their children to specialized schools or selective classes, will extra classes be pushed to a climax?
Notes on registration procedures for teaching and learning business
According to lawyer Hoang Van Liem, L&P International Law Office, Circular 29 stipulates that organizations and individuals providing private tutoring must register their business. However, teachers who are civil servants are not allowed to establish and manage businesses according to the provisions of the Enterprise Law. They can only register as individual businesses.
According to this lawyer, the procedure for registering a sole proprietorship business is quite simple. Teachers can learn about the procedure through the national public service portal, then submit their application online or online to the district-level business registration agency.
However, Mr. Liem said that Circular 29 is unclear about whether public school teachers are allowed to register for business or not.
"Article 4 of Circular 29 stipulates cases where extra teaching and extra teaching are not allowed, clearly stating in point 3: "Teachers at public schools are not allowed to participate in the management and operation of extra teaching outside of school but can participate in extra teaching outside of school", said Lawyer Liem.
