105 cities and towns will be 'banned' from dividing and selling land plots early?

The 2023 Law on Real Estate Business stipulates that land use rights cannot be transferred to individuals who build houses themselves, divide plots of land for sale in wards, districts, and cities of special, type I, II, and III urban areas, and are subject to auctions of land use rights to invest in housing construction projects according to the provisions of the Land Law.

For the remaining areas, the provincial People's Committee shall, based on local conditions, determine the areas where project investors are allowed to transfer land use rights with technical infrastructure to individuals for self-construction of houses.

It is known that the Law on Real Estate Business 2023 will officially take effect from January 1, 2025, which is about half a year away. However, the Government has recently proposed to put this law into effect early, on August 1, which is 4 months earlier than before.

Thus, in case the Government's proposal is approved by the National Assembly, the provisions of the 2023 Law on Real Estate Business, including the regulations on early subdivision and sale of land, will officially take effect.

According to statistics from the Ministry of Construction, by December 2023, there will be 902 urban areas nationwide; including 2 special urban areas, 22 type I urban areas, 36 type II urban areas, 45 type III urban areas, 95 type IV urban areas and 702 type V urban areas. Thus, the new regulation will not allow subdivision and sale of land in 105 cities and towns.

Two special urban areas including Hanoi and Ho Chi Minh City will be tightened on land subdivision and sale. 22 type I urban areas include 3 centrally-run cities: Hai Phong, Da Nang, Can Tho and 19 provincial cities: Hue, Vinh, Da Lat, Nha Trang, Quy Nhon, Buon Ma Thuot, Thai Nguyen, Nam Dinh, Viet Tri, Vung Tau, Ha Long, Thanh Hoa, Bien Hoa, My Tho, Thu Dau Mot, Bac Ninh, Hai Duong, Pleiku, Long Xuyen.
