Presenting the Report, Deputy Minister Ministry of Natural Resources and Environment Le Minh Ngan said that according to the provisions of the 2024 Land Law and Decree No. 102/2024/ND-CP, Goverment will present Congress Adjusting the National Land Use Planning for the period 2021 - 2030, with a vision to 2050, with the main contents including: adjusting 8 land use indicators including: land groups Agriculture (including land types: rice-growing land, special-use forest land, protective forest land, production forest land that is natural forest); non-agricultural land group (including land types: national defense land, security land); not submitting to the National Assembly for approval of the National Land Use Plan.
The calculation and determination of 8 land use indicators in the adjusted National Land Use Plan this time requires a thorough review and balancing of land use indicators of sectors, fields and localities; in which, priority should be given to allocating land funds for national defense and security purposes, stabilizing rice-growing land funds to ensure national food security, strictly managing forest land, maintaining forest cover to contribute to protecting the ecological environment, responding to climate change and achieving sustainable development goals.
The Government proposed the content of the National Assembly's decision on the policy of adjusting the National Land Use Plan for the 2021-2030 period, with a vision to 2050, as follows: "Agree in principle to assign the Government to organize the preparation and adjustment of the National Land Use Plan for the 2021-2030 period, with a vision to 2050, and submit it to the National Assembly for approval in 2025" and include it as a content in the Joint Resolution of the 8th Session, XNUMXth National Assembly.
Reviewing this content, the Chairman of the Committee Economy Vu Hong Thanh said that the Government's proposal to adjust the national land use plan is consistent with the requirements of the National Assembly in Resolution No. 103/2023/QH15 dated November 9, 2023 of the National Assembly, especially in the context that our country is preparing to implement a number of important national projects in the field of transport. However, there are opinions that, according to the provisions of the Law on Planning, planning adjustments are made when there is one of the 7 bases specified in Article 53 of the Law on Planning.
Meanwhile, the Submission and Report on the review of the National Land Use Plan have not clearly analyzed which of the 7 bases in Article 53 of the Law on Planning is the basis for the proposed adjustment of the National Land Use Plan. Therefore, the Standing Committee of the Economic Committee recommends that it is necessary to supplement the assessment of the urgency of adjusting the National Land Use Plan, ensuring that it meets the basis for adjusting the plan as prescribed in Article 53 of the Law on Planning.
In addition, the Government is requested to analyze and evaluate comprehensively, clarify further the causes, propose solutions to improve the effectiveness of implementing this Plan; assess the impact of policies and laws on the implementation of land use indicators...
At the meeting, the majority of delegates basically agreed with the need to submit to the National Assembly for consideration and decision on the policy of adjusting the National Land Use Plan for the 2021-2030 period, with a vision to 2050. The Government's proposal to amend 4 laws in the field of investment and 7 laws in the field of finance and budget shows great determination in perfecting the synchronization of institutions and macro policies to accelerate the implementation progress, contributing to the completion of socio-economic development goals in the coming time. However, adjusting the National Land Use Plan is a big issue, affecting all sectors, fields, and the entire economy, so careful calculations are needed to adjust only what is really necessary, avoiding disruption and affecting the stability of investment and business support policies.
Speaking at the meeting, President of Congress Tran Thanh Man emphasized the importance of the Land Use Planning for the period 2021-2030, with a vision to 2050. At the same time, it is said that when submitting this content to the National Assembly, it is necessary to clearly demonstrate the policy, ensuring compliance with the 7 bases stated in Article 53 of the Law on Planning. At the same time, clarify the bases for the necessity of adjusting the National Land Use Planning.
The National Assembly Chairman stated that the principle of adjusting the National Land Use Plan must comply with legal regulations on reviewing and adjusting plans. This is the most basic principle.
Along with that, the National Assembly Chairman suggested ensuring the need for land use to achieve socio-economic development goals, ensure national defense and security, and allocate land resources reasonably, economically, and effectively to local sectors and fields. Regarding the content of the policy on adjusting land use planning, it is necessary to clarify the contents expressing the policy on adjusting the planning, because according to the report, there is currently only a policy on necessity.
Based on the results of the review of national land use planning, the National Assembly Chairman noted that it is necessary to point out which land use indicators are being implemented ineffectively; which indicators need to be adjusted up or down, and clearly explain them for the National Assembly to consider. In addition, it is necessary to have specific tasks and solutions to overcome shortcomings and limitations in the implementation of the National Land Use Planning in recent times.
Concluding the meeting, Vice Chairman of the National Assembly Nguyen Duc Hai stated that the National Assembly Standing Committee agreed to submit to the National Assembly for consideration and decision on the policy of adjusting the Land Use Planning for the period 2021 - 2030, with a vision to 2050. At the same time, he emphasized that the Government is responsible for the data, the implementation status of the Land Use Planning for the period 2021 - 2030, with a vision to 2050, and the data on land use demand.
After 3 years of implementing the National Land Use Plan, which has been specified through land use plans for national defense and security purposes, provincial plans, annual land use plans at district level, it has brought about positive results, serving as a basis for localities to carry out land allocation, land lease, land use purpose conversion, land recovery, and land use rights recognition, contributing to meeting the socio-economic development goals, ensuring national defense and security of localities and the whole country.
According to the survey results up to December 31, 2023, nationwide, the implemented land use targets have reached about 5% to 10% compared to the land use targets until 2030 approved by the National Assembly. Of which, there are some high implementation targets such as urban land (21,99%), production forest land 19,59%, special-use forest land (14,02%),... but there are also many low targets such as land for construction of cultural facilities (1,96%), protective forest land (3,93%)...
