Strictly handle violations of the Forestry Law

In order to avoid inspection and handling by authorities at all levels and functional agencies, recently, illegal forest exploitation and deforestation subjects in Tuan Giao district have become increasingly sophisticated. This has led to illegal exploitation, purchase and sale of forest products occurring in some communes, significantly affecting forest resources and the ecological environment. From the beginning of the year to July 15, Tuan Giao District Forest Protection Department has detected 24 cases of violations of the Forestry Law and advised on handling 15 cases (administrative penalties for 15 cases), along with the proceeds from the sale of temporarily seized exhibits, over 124 million VND has been collected for the State budget. In addition to closely coordinating and collaborating with functional agencies, local authorities to inspect and prevent acts of encroachment on forest resources, resolutely handling violations of forestry laws has contributed to limiting the risk of encroachment on illegal forest exploitation, deforestation, etc.

Mr. Hang A Tenh, Deputy Head of the Forest Protection Department of Tuan Giao District, said: To prevent violations in the forestry sector, the Department has coordinated with the District Police and related agencies and units to handle complicated cases with signs of criminality; verify deforestation cases where violators have not been detected. Direct forest rangers in charge of the area to coordinate with forces at the commune level to promptly detect and prevent violations of the law in the forestry sector. Conduct inspections and control of illegal exploitation, transportation, purchase, sale, storage, and processing of forest products by organizations and individuals in the district and advise on handling according to the provisions of law.

Similar to Tuan Giao district, in the first 5 months of 2024, Muong Cha district also resolutely handled violations of the Forestry Law. Although there were 32 violations in the forestry sector, none of the cases had to be prosecuted criminally. For violations, Muong Cha District Forest Protection Department has collected fines for administrative violations in the forestry sector in 2023, and administrative violations in 2024; collected nearly 50 million VND to the State budget. To promptly detect and handle cases, the unit has directed local forest rangers to coordinate with the commune police, the commune military command, and the border guard station to properly implement the coordination regulations associated with the actual implementation of tasks in the assigned areas. Mr. Luong Van Toan, Head of the Forest Protection Department of Muong Cha district, said: In the past time, the Department has regularly coordinated with the Party Committees and authorities of communes and towns to direct departments, branches, and organizations to coordinate with local forest rangers to effectively carry out the tasks of forest management and protection as well as to implement plans and regulations on coordination between forces: local forest rangers, commune police, commune military command... With the viewpoint of resolutely handling violations of the Forestry Law, the District Forest Protection Department has coordinated with functional agencies to strictly punish cases to raise people's awareness...

Nam Po District Forest Protection Department and relevant agencies will investigate the case of violation of the Forestry Law before proceeding with the handling.

In the spirit of determination not to let wrongful convictions or criminals escape, the provincial forest rangers have coordinated with relevant agencies and functional units (police, prosecutor's office, local authorities, etc.) and the people to detect, receive, and handle many denunciations and reports of crimes. At the same time, they have received, classified, and resolved denunciations and reports of crimes according to regulations, organized the handling, and advised on the thorough and unified handling of cases. In 10 months (from October 1, 2023 to July 31, 2024), the authorities have handled 287 cases, of which 34 were criminally prosecuted and 253 were administratively prosecuted; collected over 1.5 billion VND for the state budget, and confiscated 106,188m3 of various types of wood.

Mr. Ha Luong Hong, Head of the Forest Protection Department, affirmed: The work of combating and preventing crimes in the forestry sector has always been of interest, closely led and directed by the Forest Protection Department. Based on the coordination regulations between the Department of Agriculture and Rural Development and relevant agencies (police, prosecutor's office, border guards, customs, market management, etc.); the coordination between the District Forest Protection Department and the Military Command, District Police, Border Guard Station and forest owners, the forest protection force has closely coordinated with the authorities very resolutely in the work of inspection, combat, detection and reception, handling of denunciations, reports of crimes and recommendations for prosecution. Regularly exchanging information from the time of receiving, classifying to verifying and collecting evidence. From there, promptly handle the information source in accordance with regulations, creating a basis for the investigation, prosecution and trial activities in the following stages to be accurate, correct in terms of the person and the crime, not to let criminals escape and wrongfully convict innocent people. Accordingly, during the reporting period, the forestry agency issued 34 decisions to initiate criminal proceedings in the forestry sector (crime of violating regulations on forest exploitation, protection and forest products: 03 cases; crime of forest destruction: 30 cases; crime of violating regulations on forest fire prevention and fighting: 01 case). Currently, the entire case file has been transferred to the Investigation Police Agency for investigation and handling according to its authority...

It can be seen that the forest rangers' coordination with relevant agencies to focus on investigating, verifying, and handling thoroughly, not allowing violations of the Forestry Law to linger for a long time, has been effective in deterring and educating violators. Witnessing cases being investigated and strictly handled, each person is more cautious and careful when intending or preparing to commit a violation; contributing to raising awareness, limiting crimes and violations of the law in the forestry sector in the province in the coming time.
