Trial of subjects possessing and illegally trading in drugs

On April 4, the People's Court of Dak Ha district, Kon Tum province held a public first-instance trial of the case of "Illegal possession of narcotics" and "Illegal trading of narcotics" according to the provisions of Articles 249 and 251 of the Penal Code.

According to the indictment of the People's Procuracy of Dak Ha district, due to the need to illegally use drugs and resell them for profit, on October 3, 2024, A Truyen (born in 1997), residing in Dak Hring commune, Dak Ha district, went to Dak Bla commune, Kon Tum city to buy drugs from a man named Chau for 7.6 million VND to hide for illegal use and resale for profit.

From early October to November 2024, A Truyen, through A Nhom (born in 2008) and A Thang (born in 2006), both residing in Dak Hring commune, Dak Ha district, sold drugs to many people for illegal use. For each successful sale, A Truyen paid A Nhom and A Thang 100,000 VND.

On November 15, 2024, through social networks, A Hoang Quynh (born in 2000, residing in Dak Pxi commune, Dak Ha district) contacted and bought drugs from A Truyen for use and resale for profit. On November 18, 2024, when A Quynh and A Truyen were illegally buying and selling drugs, they were discovered by the police, caught red-handed and confiscated 01 plastic bag containing white solid crystalline particles, suspected to be drugs.

At the Investigation Agency, the test results determined that the subjects A Truyen, A Hoang Quynh, A Nhom, and A Thang were all positive for the drug Methamphetamine (crystal meth). In the conclusion of the forensic examination of the Criminal Technique Department, Kon Tum Provincial Police, it was determined that: The sample of white solid crystalline particles seized from the subjects was a drug, type Methamphetamine, weighing 21.834 grams.

At the first instance trial, after considering and applying mitigating measures according to the provisions of law, based on the provisions of Article 249 and Article 251 of the Penal Code, the People's Court of Dak Ha district sentenced defendant A Truyen for the crimes of "Illegal trading of narcotics" and "Illegal possession of narcotics" with a total sentence of 14 years and 3 months in prison; defendant A Hoang Quynh was sentenced to 7 years in prison for the crime of "Illegal trading of narcotics"; defendant A Nhom was sentenced to 5 years and 3 months in prison for the crime of "Illegal trading of narcotics"; defendant A Thang was sentenced to 2 years in prison for the crime of "Illegal trading of narcotics".
