The incident at Minh Hoang 2 Garment Company Ltd.: Get involved to resolve it once and for all

(QNO) - This afternoon, April 15, Vice Chairman of the Provincial People's Committee Tran Anh Tuan chaired a meeting with the province's functional departments and branches to resolve the case of social insurance debt and benefits for employees at Minh Hoang 2 Garment Company Limited (Dien Nam - Dien Ngoc Industrial Park).

Long delay in paying social insurance

According to the Social Insurance Agency of Region XXII, Minh Hoang 2 Garment Company Limited has been owing social insurance for a long time, at times owing wages to employees, causing employees to be upset and leading to many collective work stoppages and gatherings of people to demand their rights.

Specifically, since 2019, through an inspection by the Ministry of Labor, Invalids and Social Affairs, the company has been late in paying social insurance of more than VND 8.1 billion and late payment interest of more than VND 2.1 billion for 628 employees. The debt has lasted for many years, only being paid in small amounts, until March 2025, the late payment amount is more than VND 10.3 billion. The Social Insurance Agency has continuously reminded and urged the company to pay social insurance contributions, but the company has not complied.

In January 2025, 250 employees of Minh Hoang 2 Garment Company Limited stopped working collectively for 2 days (January 21 and 22, 2025) to request the company to pay the 2024 bonus before the Lunar New Year of At Ty. The company sent an official dispatch promising to pay no later than March 31, 2025.

According to Mr. Nguyen Qui Quy - Deputy Director of the Department of Home Affairs, the province's functional departments have had meetings and official dispatches requesting the company to fulfill mandatory obligations, but the company did not fulfill its promise, so on April 8, 2025, employees gathered in front of the company gate to request the settlement of related rights.

Faced with this situation, the provincial authorities had a dialogue with the workers, asking the company's leaders to be present to resolve the issue, but the company's leaders were absent.

On April 8, 2025, the Department of Home Affairs sent a dispatch to the company, requesting urgent payment of social insurance debts, unemployment insurance and other requests of employees. Due to not being able to contact the company's leadership, on April 11, 2025, the Department of Home Affairs went to Ho Chi Minh City to work directly with the company's leadership.

Mr. Quy informed: "After the meeting, the company resolved the transfer of unemployment insurance money for February 2025 in the amount of more than 120.9 million VND. Social Insurance of Region XXII is coordinating to confirm the social insurance books for employees who have quit their jobs so that employees can complete the application for unemployment insurance settlement in accordance with regulations. Regarding the remaining two contents, which are resolving social insurance debts so that employees can close their social insurance books and pay bonuses in 2024 as requested by employees, the company has not been able to do so because the enterprise has temporarily suspended operations and has no production orders. The company is arranging funds to prioritize salary payment and then continue to pay social insurance debts and bonuses in 2024 as committed."

In addition, the company requested the provincial authorities to soon issue a land use right certificate (at Dien Nam - Dien Ngoc Industrial Park, Dien Ban town) to have a basis to resolve the issue of freezing the company's account at BIDV Bank, Binh Dien Saigon branch (amount of 14 billion VND). According to the company's opinion (represented by Mr. Le Van Vinh - Deputy Director), if this issue is resolved, the company will prioritize payment of social insurance debt and Tet bonuses for employees.

Resolve the case in accordance with the rule of law

On April 14, 2025, the Department of Home Affairs sent an official dispatch requesting Minh Hoang 2 Garment Company Limited to urgently resolve the termination of employment, close the social insurance book, and hold a dialogue to continue resolving and explaining in detail the remaining issues between the company and the employees (no later than April 16, 2025). The latest information from the company's response to the Department of Home Affairs is that on April 16, the company's leaders will be present at the factory in Dien Nam - Dien Ngoc to have a dialogue with the employees.

At the meeting, Vice Chairman of the Provincial People's Committee Tran Anh Tuan said that it is necessary to fully and thoroughly identify the issue to resolve it with the best solution, to resolve it once and for all, and not to let it drag on. If the issue drags on, it will also have a major impact on attracting investment and ensuring the rights of workers.

Mr. Tuan requested that the case must be resolved based on legal regulations, that businesses and employees are equal before the law, and that whoever is at fault must be punished according to regulations. The relevant authorities can facilitate businesses in some matters such as coordinating to explain to employees, and having time to resolve the company's financial problems.

For employees, in the dialogue between the company's leaders, employees and the authorities scheduled to take place on April 16, the provincial authorities must help them determine the debts that the company owes and need to resolve. It is necessary to guide employees through administrative procedures if they want to sue the company in accordance with the law.

Mr. Tuan requested that Dien Ban town coordinate well with the provincial departments, especially to ensure security and order in the area, not to let hot spots occur, not to let bad elements take advantage of the situation to incite and incite. State agencies with functions coordinate with each other to analyze and thoroughly resolve the incident. It is necessary to use the law to force the company to fulfill its mandatory obligations to employees. The Department of Home Affairs coordinates with functional departments such as tax, social insurance, trade unions... to complete the case file. After the meeting on April 16 at the company, the Department of Home Affairs reports to the Provincial People's Committee to have a basis to request functional departments to determine the behavior of Minh Hoang 2 Garment Company Limited, thereby proposing solutions and handling the incident. After that, the Provincial People's Committee will have a working group to resolve the incident.
