"According to the provisions of the 2018 Law on Surveying and Mapping, the 1:50,000 scale Ha Long Bay Map is a specialized map. Therefore, based on Clause 5, Article 31 and Clause 2, Article 57 of the Law on Surveying and Mapping, the content of the above specialized map is not under the management of the Ministry of Natural Resources and Environment," the Ministry said.

Regarding the authority to appraise environmental impact assessment reports, the Ministry of Natural Resources and Environment informed that the Urban Area project in Zone 10B, Quang Hanh Ward, Cam Pha City (project) is not on the List of production, business and service types that are at risk of causing environmental pollution.

The project location is within the average low water line over many years, the closest location of the project to the average low water line over many years is about 330m.

The total project area is 31.82 hectares, of which 3.88 hectares are located in the buffer zone of the world natural heritage Ha Long Bay; the investment policy was approved by the People's Committee of Quang Ninh province.

"Therefore, to correctly identify the competent authority to appraise the project's environmental impact assessment report, it is necessary to continue to clarify some contents," the Ministry of Natural Resources and Environment stated.

This Ministry analyzed that, according to Article 31 of the Investment Law 2020, projects under the Prime Minister's authority to approve investment policies include: Investment projects regardless of land area and population, within the protected area of ​​relics recognized by competent authorities as national relics or special national relics.

Investment projects in accordance with the provisions of law on cultural heritage within the scope of protection area 1 of a relic recognized by competent authorities as a national relic, special national relic or within the scope of protection area 2 of a relic recognized by competent authorities as a special national relic on the list of world heritage.

According to the Ministry of Natural Resources and Environment, Ha Long Bay is ranked as a special national monument. According to Article 32 of the Law on Cultural Heritage, the protected areas of the monument must be determined by competent state management agencies on cadastral maps, in the minutes of protection zoning of the monument dossier and must be marked in the field.

Therefore, the Ministry of Natural Resources and Environment proposed that the Ministry of Construction consult with the Ministry of Culture, Sports and Tourism to compare and contrast the project implementation location with the protected areas of the special national relic Ha Long Bay, thereby determining the authority to approve the investment policy and appraise the environmental impact assessment report of the urban area project 10B, Quang Hanh ward, Cam Pha city.

"Because Ha Long Bay is both a world heritage site and a special national scenic spot, it is necessary to compare the land area for project implementation with the boundary of Ha Long Bay when it is established and recognized as a world heritage site and a special national scenic spot to serve as a basis for comparison with environmental criteria ," the Ministry of Natural Resources and Environment emphasized.

Previously, on November 8, 2023, the Government Office issued Document No. 6769/VPCP-CN dated November 8, 2023 conveying the direction of Deputy Prime Minister Tran Hong Ha on the above project.

The Deputy Prime Minister assigned the Ministry of Construction to preside over and coordinate with the Ministry of Culture, Sports and Tourism, the Ministry of Natural Resources and Environment, and the People's Committee of Quang Ninh province to inspect the content reported by the press agencies at the 10B Urban Area Project, and handle it according to their authority and regulations. The inspection results will be reported to the Prime Minister before November 25, 2023.

The 10B urban area project in Quang Hanh ward, Cam Pha city, was approved in 2021 with a total investment of more than 1,230 billion VND, an area of ​​nearly 32 hectares, of which nearly 3.9 hectares belong to protection zone II (buffer zone) of the special national monument of Ha Long Bay.
