Violation of the prohibitions of the Food Safety Law

The Department of Food Safety - Ministry of Health requested the Department of Food Safety of Ho Chi Minh City to urgently and actively investigate and handle the suspected food poisoning case that occurred at 2 facilities in Thu Duc City belonging to the Tue Duc school system.
This suspected poisoning incident directly affected at least 33 students of the school. According to initial reports, the students showed symptoms of stomachache, nausea... after eating at the school provided by the same company in Tan Phu district (Ho Chi Minh City).
According to Quick Report No. 19/2025-BCN.TĐ dated March 26, 2025 of Tue Duc Secondary School, the School has signed a contract with a meal supplier by Haxeca Mekong International Joint Stock Company - represented by Mr. Nguyen Anh Tuan (General Director), address 6 - 8 Nguyen Hau, Tan Thanh Ward, Tan Phu District (Ho Chi Minh City) (the correct name of the unit is Haseca Mekong International Joint Stock Company, Business Registration Certificate No. 0316149895 (Haseca Mekong Company).

According to bidding data, in the past, Haseca Mekong Company participated in bidding for 6 packages to provide meals for students in schools in Ho Chi Minh City. Of which, in the 3 recent packages (February 2025), Haseca Mekong Company failed.
Specifically: Haseca Mekong Company failed the bid for the Le Anh Xuan Primary School (District 7) with an approved price of over 9 billion VND. This bid had 3 bidders. Haseca Mekong Company failed due to the reason of "not meeting the technical requirements as required by E-HSMT".
According to the Bidding Document Evaluation Report prepared by CICON Construction Investment Consulting Co., Ltd. on February 11, 2025, 2 inappropriate points were pointed out in the dossier of Haseca Mekong Company, including: explaining the process of transporting and dividing meals at school 1 hour before meal time is not meeting the requirement of providing meals 30 minutes before meal time for students to ensure the food is still warm; explaining the handling of food hygiene and safety incidents on how to deploy raw materials in the kitchen warehouse: Rotten or torn packaging affecting the quality of raw materials is treated and replaced with new packaging for reuse, which is a violation of one of the prohibited acts in Point d, Clause 5, Article 5 and Point d, Clause 1, Article 55 of the Food Safety Law No. 55/2010/QH12 dated June 17, 2010.
Also in February 2025, Haseca Mekong Company failed the bid for the package of providing meals for boarding students at Pham Huu Lau Primary School (District 7), the bid package had an approved price of more than 23 billion VND, implementation period of 24 months. This bid package, Haseca Mekong Company failed for the same reason: "the contractor did not meet the technical requirements according to the E-HSMT requirements" (this bid package was won by Hanh Phuc Culinary Company Limited).
Most recently, on February 28, 2025, Haseca Mekong Company failed the bid for the package of providing meals for boarding students at Luong Vinh Primary School (District 7). The bid package had an approved price of more than 30 billion VND, with a implementation period of 23 months. Haseca Mekong Company also failed for the reason: "the contractor did not meet the technical requirements according to the E-HSMT requirements" (this bid package was won by Xich Long Food Company Limited).
One time bid for 3 consecutive years of providing meals

Meanwhile, according to bidding documents, in September 2024, Haseca Mekong Company won the bid to provide meals for boarding students at Nguyen Thi Thap Secondary School (District 7).
Accordingly, on September 6, 2024, the Principal of Nguyen Thi Thap Secondary School (District 7) Vo Bao Dao Diem signed Decision No. 86/QD-NTT approving the results of the contractor selection for Package No. 03: providing meals for boarding students of the school. Haseco Mekong Company won the bid with a price of more than: 35.9 billion VND (including fees, charges and VAT). The capital source is from the source of support for individual students; contract type: adjusted unit price. Package implementation period: 27 months. Contract implementation period (3 school years): 2024 - 2025, 2025 - 2026, 2026 - 2027.
According to the E-HSDT Evaluation Report for the above bid package by Ngoc Nhi Consulting Company Limited (the unit evaluating the bidding documents), Haseca Mekong Company is the only unit participating and winning the bid (winning the bid at the correct bidding price).
Previously, in August 2023, Haseco Mekong Company also won the bid to provide meals for students of Le Van Tam Primary School (District 7) with a winning bid price of more than 23.7 billion VND (contingency cost of more than 2.9 billion VND). The contract implementation period is 3 school years (2023 - 2024, 2024 - 2025, 2025 - 2026).
