Vietnam and the United States have reached an agreement in the dispute settlement case over anti-dumping tax on tra and basa fish at the World Trade Organization (WTO).
Dispute Resolution in DS536 Case at WTO
On January 17, 2025, in Washington, USA, the Ministry of Industry and Trade, authorized by the Government, signed a Bilateral Agreement between the Government of the United States of America and the Government of the Socialist Republic of Vietnam on the imposition of anti-dumping duties on fish fillets from Vietnam with the representative of the United States Government - the Office of the United States Trade Representative (USTR).
Thus, the two sides have reached a bilateral solution to end the dispute issues in case DS536 at the World Trade Organization (WTO).
According to this agreement, the Ministry of Industry and Trade said that Vinh Hoan Joint Stock Company - the only enterprise eligible for tax removal under US regulations and also the leading exporter of tra and basa fish in Vietnam - has been removed from the scope of anti-dumping tax when exporting tra and basa fish to the US.
The Ministry of Industry and Trade emphasized that this is the second time Vietnam and the United States have reached a bilateral agreement to resolve a dispute at the WTO, in addition to the case of anti-dumping tax on warm-water shrimp products (DS429).
In 2016, Vietnam and the United States signed a bilateral agreement to remove anti-dumping duties on warm-water shrimp products exported to the United States by Minh Phu Seafood Corporation.

Previously, on January 8, 2018, Vietnam officially sued the United States for violating World Trade Organization (WTO) regulations when applying anti-dumping tax on Vietnamese tra and basa fish products exported to the US market (case DS536).
In 2020, after the WTO Panel had a draft ruling on the case sent to the relevant parties before the official announcement, the US side proposed that the Vietnamese Government also request to postpone the issuance of the Panel's report to negotiate a bilateral solution to resolve the DS536 case.

The Ministry of Industry and Trade stated that Vietnam and the United States reached a bilateral solution to resolve the tra and basa fish lawsuit as a result of goodwill and negotiation efforts from both sides. Vietnam welcomes the constructive spirit, goodwill and efforts to seek a bilateral solution from the United States, especially the US Department of Commerce (DOC) and the Office of the United States Trade Representative (USTR).
At the same time, the US's enforcement of the WTO ruling also contributes significantly to demonstrating goodwill in strengthening the multifaceted relationship between Vietnam and the US, especially in the context of the two countries upgrading their Comprehensive Strategic Partnership.

On the Vietnamese side, according to the Ministry of Industry and Trade, this is the result of close, persistent and active coordination over many years between the Government, lawyers advising the Government and seafood enterprises, especially Vinh Hoan Joint Stock Company.
" This bilateral solution shows that the Vietnamese Government is always ready to use appropriate forums, including the WTO dispute settlement mechanism, to ensure the legitimate rights and interests of Vietnamese enterprises in the context of Vietnam's increasingly deep integration into the international economy," the Ministry of Industry and Trade stated.
