After several months, with so many procedures, there were times when he thought he would give up, the overseas Vietnamese finally got his ID card. After another month of looking at real estate listings and going to see houses, he finally chose a small house in the city center.
When buying, he set a principle of writing the correct purchase price on the contract. Then the day of notarization came. That was also the time when society was noisy about the new land price list being many times higher than the old price list.
Because he has read and learned a lot of information about land prices and problems, he is confident that the problem will not apply to him.
He has two pretty solid arguments. First, the buyer already has a pink book, does not need to change the land use purpose or transfer new land, so there is no land use fee or land price list.
Second, the price stated in the notarized contract is the correct purchase price, i.e. the market price, so there is no need to apply the land price list to calculate personal income tax. Just apply 2% on the contract price and the registration fee is calculated similarly.
But that's your argument. The authorities don't do that. Submit the application at the land registration office, on the appointed day you go there to ask, just go to the tax office, meet the tax office, this place said stop, not accepting to process the application.
He waited patiently. One, two, three weeks... passed, he changed his plane ticket twice to return home to a foreign country, it was too expensive, and he had work. He didn't know what to do if he waited. So he had to authorize an acquaintance to help him with the paperwork.
But that's not all. A series of troubles made him tired. First was the trouble with the seller. The seller kept urging the overseas Vietnamese to pay the rest of the house purchase price. But the contract clearly stated that the house had not been registered yet, so how could he pay the rest? If anything happened, it would be difficult to call the seller.
The overseas Vietnamese wishes the tax office would accept the documents, calculate the taxes, and then register the house so he could pay off the house to ease his mind. That's all he wishes for, but now it's all stuck.
But it is also difficult for the seller to suddenly have to pay taxes unjustly. According to the provisions of the Personal Income Tax Law, the seller of the only house does not have to pay taxes.
However, because the transfer of ownership to the buyer was not completed because the tax could not be calculated, while the deposit for another house was placed, the seller of the other house also urged him to sign the notarization and payment. So the seller of the house to the overseas Vietnamese fell into the situation of having two houses.
That is, playing the role of a homeowner who has sold the house but has not completed the paperwork, and playing the role of another home buyer who has paid a deposit and agreed to sign a notarized contract.
Sell this house, buy another smaller one to save some money, but suddenly have... two houses, have to pay personal income tax. They complain "beggars knock down bridges and ponds". It's so miserable but now even if they want to pay taxes to finish the procedure, they can't.
Second is the trouble with the contractor. The overseas Vietnamese who bought the house had a contract to renovate the house with the contractor, had advanced the money and prepared everything, now he hasn't transferred the ownership yet, how can he dare to paint, destroy, and renovate it?
The contractor blamed him, urged him to try, spent a lot of money to arrange for workers, now he was sitting and waiting, lucky not to ask for compensation... The overseas Vietnamese went home worried, when he returned, he didn't know what the contractor would do!
The deadlock has led to one person keeping the other's money, the other person owing money to the other person, everyone's calculations are broken, afraid that the other side is keeping their money, and the State has taxes but cannot collect them.
The overseas Vietnamese man went from excitement to bewilderment, now waiting for the day to board the plane to return home to a foreign land, his heart filled with confusion because after many days of hard work, he still cannot own a house as per the spirit of the three new laws...!
