On the afternoon of May 21, the Ministry of Public Security announced that the draft Law on Road Traffic Order and Safety is expected to be submitted to the 15th National Assembly for consideration, comments and approval at the 7th session.
Compared to the current law, this draft adds Article 37 to legalize regulations on vehicle license plate auctions.
Specifically, Article 37 has new content such as: License plates put up for auction are license plates of cars, motorbikes, and mopeds; the starting price of a license plate of a car put up for auction is not lower than 40 million; the starting price of a license plate of a motorbike or moped put up for auction is not lower than 5 million.
Motorcycle license plates are being randomly selected at the commune police station.
Regarding the reason for adding the above contents, the Ministry of Public Security emphasized that according to the provisions of the Civil Code, the Law on Management and Use of Public Assets, the Law on Property Auction, the Law on Road Traffic..., vehicle license plates are public assets, serving State management.
However, the exploitation of the license plate warehouse faces difficulties and legal problems such as: There is no legal basis for granting license plates through auction; there are no regulations on the management of auction-winning license plates, rights and obligations of auction winners; determining starting prices, etc.
Studying and referring to international experience in exploiting and managing public assets, the National Assembly issued Resolution No. 73/2022/QH15 dated November 15, 2022 on piloting the auction of car license plates (white background, black letters and numbers) from September 15, 2023 to the end of February 2024.
After nearly 6 months of implementation, the units successfully organized online auctions of more than 15,100 car license plates, with a total auction price of over 2 trillion VND. Of which, 14,062 car license plates won the auction and customers paid a total of nearly 1.4 trillion VND.
Currently, the Ministry of Public Security continues to reform administrative procedures, reduce the number of documents required for registration, and decentralize vehicle registration to district and commune police to reduce waiting time for people and businesses.
In particular, the authorities are transferring and managing license plates according to the vehicle owner's identification code, transacting through the public service portal to register and issue license plates, meeting the national digital transformation program.
According to the Ministry of Public Security, the license plate auction is only piloted for white-background car license plates, and has not been widely applied to other types of car license plates and motorcycle license plates. Therefore, it has not fully met the wishes of those who want to own a license plate according to their preferences.
Therefore, it is very necessary to legalize the provisions of Resolution No. 73/2022/QH15 on pilot auction of vehicle license plates into the Law on Road Traffic Safety and Order, in accordance with current regulations on the issuance and management of vehicle license plates according to identification codes.
In Article 37 of the draft Law on Road Traffic Safety, the Ministry of Public Security also proposed sanctions to be applied to those who win the license plate auction but do not fulfill their financial obligations and forfeit their deposit.
Accordingly, the person who wins the license plate auction is obliged to pay the full amount of the auction within 30 days from the date of announcement of the auction result. The person participating in the auction who does not confirm the minutes, the person who wins the auction who does not pay the full amount of the auction will not receive the deposit back and will not be allowed to participate in the license plate auction within 12 months.
