On the afternoon of April 16, continuing the 44th session of the National Assembly Standing Committee, the National Assembly Standing Committee reviewed the report summarizing the results of monitoring legal documents in the areas under the responsibility of the Ethnic Council and the National Assembly Committees in 2024.
Presenting a summary report on the monitoring results, Chairman of the National Assembly's Committee for People's Aspirations and Supervision Duong Thanh Binh said that, basically, the Government , ministries and branches have made great efforts in implementing the recommendations of the National Assembly agencies at the previous monitoring session; 52 additional detailed regulations that were previously outstanding have been issued, and there are still 35 detailed regulations for the implementation of 14 laws and 2 ordinances that have not been issued, including contents that have been outstanding for more than 10 years and have been repeatedly recommended.
There are 4 legal documents with inappropriate provisions, failing to ensure the strictness and consistency of the legal system, but have not been amended or supplemented. There are 79 documents issued later than the effective date of the laws, ordinances and resolutions; there are 147 articles and clauses of 21 laws with detailed regulations that have not been issued. The issued legal documents basically ensure compliance with the provisions of the Constitution, laws, resolutions of the National Assembly, ordinances and resolutions of the National Assembly Standing Committee.
Through supervision, the National Assembly agencies have pointed out 3 documents that do not ensure the consistency and synchronization of the legal system, 3 documents and 22 contents that are not suitable, have not been specifically regulated, and have difficulties and problems in implementation. There are still 3 documents issued without proper authority, 16 documents issued but not published in the Official Gazette on time.
The National Assembly's Committee for People's Aspirations and Supervision requested the National Assembly Standing Committee to direct relevant agencies to properly implement the provisions of the Law on Promulgation of Legal Documents and continue to strongly innovate thinking in legislative work, ensuring that laws, ordinances and resolutions are issued with stability and longevity, promptly removing difficulties and obstacles in practice, and unleashing all potentials and resources to meet the country's development requirements in the new period.
The Committee also proposed to strengthen the supreme supervision of the National Assembly, the supervision of the National Assembly Standing Committee, the National Assembly agencies and National Assembly deputies over legal documents, and have an effective mechanism to ensure strict implementation of conclusions and recommendations after supervision.
The report also recommends that the Government, ministries, sectors and relevant agencies continue to focus on and enhance the effectiveness and efficiency of the promulgation of legal documents. Relevant parties must thoroughly overcome the shortcomings and limitations pointed out in previous monitoring periods and in 2024.
The competent authorities regularly direct, inspect, urge and effectively coordinate the work between agencies in the process of drafting detailed regulations to ensure progress and quality.
Chairman of the National Assembly Delegation Affairs Committee Nguyen Thanh Hai raised the issue of needing to review and make early recommendations if legal loopholes are discovered, such as the recent case involving the production and trading of nearly 600 types of fake milk. The delegate said it is necessary to determine whether or not there is a legal gap related to post-inspection of circulating milk products.
Vice Chairman of the National Assembly Tran Quang Phuong emphasized the need to innovate thinking in law-making and methods, improve capacity, effectiveness and efficiency of monitoring legal documents; combine and integrate monitoring of legal documents with other monitoring activities.
Monitoring work needs to be carried out regularly, monitoring the whole process, from the beginning of policy formation, policy issuance and policy implementation.
Authorities should step up review to promptly detect conflicting, overlapping content and signs of illegality for immediate handling, focusing on assessing the social impact of delayed promulgation and promulgation of inappropriate legal documents.../.
