The Committee on National Defense, Security and Foreign Affairs reviews the draft Law on Participation in United Nations Peacekeeping Forces.

On the afternoon of April 23, at the National Assembly Office (22 Hung Vuong, Hanoi), continuing the first plenary session, chaired by the Party Central Committee member, Chairman of the National Defense, Security and Foreign Affairs Committee, Lieutenant General Le Tan Toi, the National Defense, Security and Foreign Affairs Committee examined the draft Law on Participation in United Nations Peacekeeping Forces.

Also attending were: Vice Chairmen and members of the Committee on National Defense, Security and Foreign Affairs; representatives of the Ministry of National Defense, the Drafting Committee of the Law Project and relevant ministries and branches.

In his opening remarks at the meeting, Chairman of the Committee on National Defense, Security and Foreign Affairs Le Tan Toi said that from April 3 to 16, the Committee organized a survey delegation to work at the Training Center under the Ministry of Public Security's Standing Office on United Nations Peacekeeping; the Command of the Engineering Corps, the Vietnam Peacekeeping Department and the Military Medical Academy under the Ministry of National Defense and many other units to obtain more information during the research process and give opinions on the draft Law on Participation in United Nations Peacekeeping Forces.

To contribute to completing the review report of the draft Law, the Chairman of the National Defense, Security and Foreign Affairs Committee hopes that delegates will promote a spirit of serious and responsible work and actively contribute opinions on the contents of the draft Law.

According to the Draft Law on Participation in United Nations Peacekeeping Forces, the drafting of the Law aims to perfect the legal framework for Vietnam's participation in this activity; promptly and fully institutionalize the Party's guidelines and policies, the Constitution, policies, laws of the State and international treaties to which Vietnam is a member. At the same time, it aims to overcome shortcomings and limitations of current regulations; improve the effectiveness of management, command, direction, administration and task implementation; ensure reasonable regimes and policies; shorten the process and legal procedures in appointing, adjusting, extending working terms, withdrawing forces, especially withdrawing forces in emergency cases; and handle issues arising in the locality.

The draft Law consists of 4 Chapters and 26 Articles, specifying 3 policies in the proposal to develop the Law that the Government submitted to the National Assembly for approval. These are: building Vietnamese forces to participate in UN peacekeeping activities; deploying forces to participate in UN peacekeeping activities; ensuring resources; regimes and policies.

The majority of opinions of the Committee on National Defense, Security and Foreign Affairs basically agreed with the necessity of promulgating the Law on Participation in the United Nations Peacekeeping Force; agreed to add the subject of application as "officials, civil servants, and public employees" participating in the United Nations peacekeeping force in Clause 2, Article 2. At the same time, it is proposed to clarify the subject specified in Clause 3, Article 2: which relevant agencies, units, organizations, and individuals are, because it is not specifically stipulated in the draft Law.

There are suggestions to more clearly define the State's policy (Article 7) on gender equality in the draft Law; add provisions on preferential and highly encouraging regimes and policies for female forces participating in the United Nations peacekeeping force in Article 25 of the draft Law, ensuring gender compatibility and consistency with the provisions of the Law on Gender Equality. In addition, review and specify the policies stipulated in this Article in the chapters, sections and articles of the draft Law to ensure completeness, consistency, rigor and feasibility.

In Clause 1, Article 12 on Vietnamese forces participating in UN peacekeeping operations, there is a proposal to add a general provision on Vietnamese forces participating in these operations (including direct forces and indirect forces); review the phrase "weapons, technical equipment, technical means of operation" to ensure consistency.

There are suggestions to review Clause 3, Article 12 and Clause 3, Article 13 on the selection of forces participating in UN peacekeeping operations in the direction that the Government assigns a presiding agency to coordinate with ministries, branches and localities to stipulate conditions and selection criteria for civilian forces; decide on technical and professional means suitable for the sector and field of selection to ensure concentration, unity and avoid spreading...

Concluding the meeting, Vice Chairman of the National Defense, Security and Foreign Affairs Committee Do Quang Thanh suggested that the Standing Committee of the Committee receive the opinions of the delegates to complete the draft Verification Report and continue to study, revise and complete the draft Law before submitting it to the National Assembly Standing Committee and the National Assembly for comments.
