The Committee on Law and Justice reviewed two draft laws and two draft resolutions.

Attending the event were: Member of the Party Central Committee, Minister of Justice Nguyen Hai Ninh; members of the Law and Justice Committee; representatives of the Standing Committee of the Nationalities Council and a number of Committees of the National Assembly; representatives of the leaders of the Ministry of Construction, the Supreme People's Procuracy and a number of relevant agencies.

According to the Draft Resolution of the National Assembly on piloting a number of specific mechanisms and policies for social housing development, the draft Resolution consists of 16 Articles, piloting a number of specific mechanisms and policies for social housing development (including social housing, housing for the people's armed forces, and workers' accommodation in industrial parks) nationwide.

The subjects of application of the resolution include agencies, units, enterprises, organizations and individuals related to the development, management and use of social housing, workers' accommodation in industrial zones and housing for the people's armed forces.

The draft Resolution stipulates that the Government establishes a National Housing Development Fund from the State budget and other legal sources as prescribed to support enterprises and organizations in investing and creating social housing; support site clearance costs; support investment in technical infrastructure and social infrastructure systems; support enterprises in investing in building social housing and beneficiaries of social housing policies.

The Law and Justice Committee basically approved the establishment of the National Housing Development Fund, however, there were suggestions to clarify the Fund model to have a basis for the Government to specify in detail; clarify the Fund's expenditure tasks to ensure that the Fund's expenditure tasks do not overlap with the State budget's expenditure tasks, ensuring strictness, avoiding loopholes, loss and waste.

Regarding the approval of the investment policy and the assignment of investors to the project to invest in the construction of social housing and housing for the people's armed forces without using public investment capital (Articles 5 and 6), opinions suggested that the drafting agency continue to study and supplement the mechanism for monitoring and controlling effective implementation, preventing and combating loopholes, corruption, negativity, and waste.

+ According to the Submission of the Law Project on amending and supplementing a number of articles of the Law on Promulgation of Legal Documents, the draft Law amends and supplements a number of regulations related to the development and promulgation of legal documents of commune-level authorities; the role of the Vietnam Fatherland Front in the development and promulgation of legal documents; amends and supplements a number of regulations to meet the requirements of science and technology development, innovation, creativity and digital transformation; and amends and supplements a number of regulations to facilitate the implementation of the Law.

The draft Law amends and completes the system of legal documents in the direction of removing the authority to issue legal documents of district-level authorities, replacing them with the authority to issue legal documents of People's Councils and People's Committees at commune level, in order to concretize the policy of eliminating district-level administrative units and organizing two-level local governments (including provincial and communal levels).

Members of the Law and Justice Committee agreed to develop the project according to the simplified procedures.

Point c, Clause 1, Article 21, Clause 2, Article 22, adds the provision that the People's Councils at the provincial and communal levels issue resolutions to regulate "decentralization". Some opinions say that this provision is not consistent with the provisions of the Law on Organization of Local Government in that decentralization only applies to the activities of the system of state administrative agencies. Therefore, it is proposed not to stipulate that the documents of the People's Council are decentralized.

On the other hand, the validity of legal documents in the case of reorganizing provincial and communal administrative units has been stipulated in Article 54 of the current Law on Promulgation of Legal Documents. Therefore, it is recommended to review the provisions in Clause 2, Article 54 to propose amendments and supplements if necessary; only provide transitional provisions for handling legal documents of district-level authorities.

+ Examining the draft Resolution of the National Assembly on piloting the People's Procuracy initiating civil lawsuits to protect the civil rights of vulnerable groups or to protect public interests, the Committee on Law and Justice found that the regulation that the People's Procuracy at the provincial level and the Supreme People's Procuracy have the authority to initiate lawsuits with the same criteria is inappropriate and unclear.

Therefore, it is recommended that the drafting agency clearly stipulate the authority of the People's Procuracy at each level in initiating civil public interest lawsuits.

In addition, it is recommended to consider prescribing a number of appropriate authorities for the People's Procuracy when inspecting, verifying, and collecting documents and evidence to ensure the effectiveness and efficiency of the litigation process.

Also this afternoon, the Law and Justice Committee reviewed the draft Law amending and supplementing a number of articles of the Law on Nationality.
