According to the Draft Law on amending and supplementing a number of articles of the Law on Planning, there are 2 articles. Article 1 amends and supplements a number of articles of the Law on Planning, including amending and supplementing 28 articles, clauses and 2 appendices of the Law on Planning; Article 2 is the implementation provision.
The draft Law supplements regulations allowing organizations to simultaneously establish national, regional, and provincial planning in accordance with the spirit of Resolution No. 61/2022/QH15 of the National Assembly. The planning that is established and appraised first will be decided or approved first. When the planning is decided or approved, if there is a conflict between the lower planning and the higher planning, the lower planning must be adjusted according to the higher planning. Supplement regulations allowing technical and specialized planning to be established simultaneously with national, regional, and provincial planning in cases where relevant laws so provide.

The Draft Law also amends and supplements regulations on the planning system, including the national planning system and technical and specialized planning.
The Economic and Financial Committee found that the draft Law has been amended and supplemented in the direction of strengthening the decentralization of authority over planning activities, which is consistent with the requirements in Conclusion No. 121-KL/TW dated January 24, 2025 of the Party Central Committee.
Some delegates are concerned about the impact on the planning system with many approved provincial plans in the context of the upcoming provincial merger, and how these plans should be handled so that they can be quickly implemented. How is this issue handled in the draft Law?

The opinions also suggested clarifying the basis and criteria for evaluating investment projects in accordance with planning when the content of national, regional and provincial planning is only indicative; at the same time, it was suggested to review relevant laws such as the Law on Public Investment, the Law on Investment, the Law on Investment under the public-private partnership model, etc. to ensure consistency and consistency with the policies and orientations when amending the Law on Planning and to avoid obstacles in the implementation process.
Regarding the adjustment of the National Land Use Plan for the period 2021 - 2030, with a vision to 2050, the Economic and Financial Committee agreed on the need to submit to the National Assembly a Resolution on this content. However, it suggested that the Government continue to update and supplement the opinions of a number of ministries, branches and localities, especially the opinions of the ministries managing the sectors and fields, to ensure the connection, synchronization and unity among the sectors.

Opinions also suggested that, regarding the national land use target by 2030, the Government should pay attention to reducing the area of rice-growing land to ensure food security, export and application of scientific and technological advances in production. Regarding rice-growing land data, it is suggested that the Government add notes on land for two-crop rice cultivation, because this is a type of high-quality land that needs to be strictly controlled and conversion limited.
Examining the draft Law amending and supplementing a number of articles of the Law on Credit Institutions and the draft Law on Enterprises (amended), the Economic and Financial Committee agreed on the necessity of promulgating these laws to institutionalize the Party's policies, in accordance with the tasks set out in the National Assembly's resolutions, while meeting practical requirements for institutional improvement in the monetary and banking sector; creating a favorable, safe and equal investment and business environment for business development.

In addition, comments noted that the policies proposed in the draft Law amending and supplementing a number of articles of the Law on Credit Institutions must be thoroughly and comprehensively assessed for their impact on relevant parties. Regulations must ensure transparency, objectivity, enhance discipline, order, compliance with professional ethics and social responsibility of credit institutions in the process of credit assessment, appraisal and debt settlement; prevent the risk of abusing legal provisions, infringing upon the rights and legitimate interests of relevant parties.
Regarding the draft Law on Enterprises (amended), delegates suggested clarifying and reviewing the provisions of the Law on Anti-Money Laundering to ensure consistency, coherence, and persuasiveness. At the same time, attention should be paid to designing policies to prevent ghost enterprises, tax evasion, etc.; supplementing a complete legal basis, ensuring the quality of the draft Law dossier when submitting it to the National Assembly for consideration and approval at the Ninth Session according to the 1-session process.
