On the morning of March 19, the working delegation of the National Assembly's Economic and Financial Committee led by Ms. Doan Thi Thanh Mai, Vice Chairwoman of the National Assembly's Economic and Financial Committee, had a working session at the Provincial People's Committee on the review and adjustment of land use planning for the period 2021 - 2030, with a vision to 2050, and monitoring the issuance of documents implementing the 2024 Land Law.

According to the Assessment Report of the Provincial People's Committee, the Planning of Dak Lak province for the period 2021-2030, with a vision to 2050, was approved by the Prime Minister in Decision No. 1747/QD-TTg dated December 30, 2023. In Decision No. 1747/QD-TTg, the Prime Minister approved the land use targets of Dak Lak province until 2030, including: Targets according to the Prime Minister's allocation in Decision No. 326/QD-TTg dated March 9, 2022 and Targets according to the province's needs.

Based on Decision No. 1747/QD-TTg, Dak Lak Provincial People's Committee issued Decision No. 105/QD-UBND dated January 17, 2025, allocating land use targets of the Land Allocation and Zoning Plan in the Provincial Planning to the district level. Currently, the People's Committees of districts, towns and cities are implementing the adjustment of local land use planning to 2030. In the process of implementing the adjustment of district-level planning, the tasks and solutions identified in the land allocation and zoning plan in the provincial planning will be specified.

The results of implementing land use planning targets according to the land allocation and zoning plan in the provincial planning are as follows: Agricultural land implemented 1,193,028 ha/1,154,960 ha approved, reaching 103.30%; Non-agricultural land implemented 98,669 ha/151,311 ha approved, reaching 65.21%; Unused land put into use 6,338 ha/20,840 ha, reaching 30.41%.
However, the target for non-agricultural land use is mostly lower than the plan, as shown by the number of works, projects and areas that have not been implemented, which still accounts for a high proportion compared to the Prime Minister's approval decision. Land use planning and plans have not paid much attention to considering the financial capacity for implementation, have not forecasted the fluctuations of the market, the impacts of domestic economic development and the impact of the world economy on land use, making land use plans have low feasibility and are often changed. Some investment projects lack capital, leading to slow project implementation and not being implemented according to the set plan.
Members of the Working Group exchanged and discussed some difficulties and obstacles in implementing the 2024 Land Law.
Regarding the adjustment of land use demand until 2030, with a vision to 2050, Dak Lak province proposed: National defense land adjusted to increase by 390 hectares; Security land proposed to increase by 126 hectares; Industrial park land proposed to increase by 1,479 hectares; Land used for mineral activities adjusted to increase by 1,000 hectares; Land for traffic works adjusted to increase by 6,000 hectares; Land for energy works and public lighting reduced by 1,800 hectares, because the Ministry of Industry and Trade is currently adjusting the Power Plan VIII;
Regarding the implementation of the 2024 Land Law, Dak Lak province has issued 13 documents detailing the implementation and documents guiding the implementation of the Law. However, the implementation process has encountered some difficulties and problems such as: The 2024 Land Law stipulates a number of new types of land compared to the 2013 Land Law, but the provisions of the law do not have transitional provisions, so there are difficulties in the process of implementing approved planning, preparation, appraisal and approval. Therefore, the 2025 District-level Land Use Plan is behind schedule (approved before December 31, 2024); The method for determining land use needs for each type has not been specifically regulated in the Land Law, so the determination of land use targets is often synthesized based on the registration needs of sectors and localities, the determination of land use targets is not close to reality....

Dak Lak Provincial People's Committee proposed that the working group consider a group of issues such as: Supplementing regulations on criteria to determine which cases should be adjusted and which cases should be canceled for projects that have been registered for 2 consecutive years but have not been implemented according to the provisions of Clause 7, Article 76 of the Land Law; Supplementing provisions on transition of land types that have changed between the 2024 Land Law and the 2013 Land Law; Proposing to study and consider supplementing regulations on annual land use at the district level until the end of the implementation period, if the next year's plan has not been approved, it will continue to be implemented in Decree 102/2024/ND-CP; Proposing competent authorities to study and consider proposing solutions for cases of dissolution of district-level administrative units where the adjustment of district-level land use planning has not been approved....
At the meeting, the members of the working group exchanged and discussed with the province a number of groups of issues such as: Methods to calculate land use needs for each type of land in the process of land use planning; Determining planning indicators for 62 types of land; adjusting agricultural land to non-agricultural land slower than planned; industrial park land; adjusting unused land indicators;
Discussing with the working delegation, comrade Nguyen Thien Van - Vice Chairman of the Provincial People's Committee highly appreciated the opinions of the members, thereby helping the locality to organize the implementation of the Land Law to ensure timely, synchronous, unified, effective and efficient promotion of land resources to meet growth targets in the new period.
Concluding the meeting, Vice Chairwoman of the National Assembly's Economic and Financial Committee Doan Thi Thanh Mai highly appreciated Dak Lak province's initiative in completing the promulgation of legal documents implementing the Land Law. At the same time, she affirmed that Dak Lak province has paid attention to adjusting land use planning in accordance with the progress of the phase, and the implementation of the province's land use planning and plans has achieved many positive results.
In the coming time, Comrade Doan Thi Thanh Mai also requested the People's Council and People's Committee of Dak Lak province to continue to study and review land use indicators in the planning, land use plans and allocation indicators according to Decision No. 326/QD-TTg to propose and propose adjustments and supplements to suit the reality; do better in the work of establishing, appraising and approving district-level land use planning and plans; continue to implement the Land Law through concretization in legal documents of the province...
Dak Lak Provincial People's Committee needs to pay attention to issuing documents guiding the implementation of the Land Law, focusing on 4 groups of issues: Reviewing land use indicators for the period 2021-2025 and sending them to the delegation before March 26, 2025 to clearly explain some of the above-mentioned shortcomings; adjusting land use indicators for the period 2026-2030 to ensure feasibility, making specific recommendations on existing issues, and proposing to the Government, the National Assembly, and the Ministry of Agriculture and Environment to ensure consistency in data and adjustment plans; paying attention to land planning in accordance with the policy of merging provinces and abolishing district levels; continuing to promptly make recommendations on difficulties and obstacles in the implementation of the 2024 Land Law in the province in accordance with practical needs.
