On the afternoon of May 28, the 15th National Assembly will listen to the presentation of the Report on explanation, acceptance and revision of the draft Law on the Capital (amended) and discuss in the hall a number of contents with different opinions of this Draft Law.

Talking to VNA reporters on the sidelines of the parliament, many delegates assessed that the Law on the Capital (amended) has many unique and outstanding policies and promotes decentralization and delegation of power; strictly ensuring legislative techniques and quality of legal regulations. From there, it is expected that the Law will create conditions and development mechanisms commensurate with the position and role of the capital city of Hanoi.
Delegate Nguyen Phuong Thuy (Hanoi Delegation): Many unique and outstanding policies
The Capital Law (amended) submitted to the National Assembly at this 7th Session consists of 7 chapters and 54 articles, which is a huge change compared to the 2012 Capital Law. The policies proposed in this Draft Law basically follow the guiding spirit of Resolution No. 15-NQ/TW dated May 5, 2022 of the Politburo on the direction and tasks of developing the Capital Hanoi to 2030, with a vision to 2045, and have demonstrated a unique and outstanding policy. From there, it creates a foundation for the continued development of the Capital Hanoi in general.
During the process of completion, the Draft Law has focused on presenting policies that create a basis for the Hanoi government to continue proposing and perfecting the system of solutions and measures in the field of state management. In particular, focusing on solutions on resource mobilization, investment, planning as well as measures and policies on cultural development, education, health, social security, etc.
It is worth noting that this is a very strong solution for Hanoi to overcome the most current problems such as urban landscape, traffic, environmental pollution, etc.
The Capital Law (amended) has many outstanding and specific policies in many comprehensive fields. However, to put these policies into practice and implement them effectively, it still requires competent and enthusiastic human resources to implement them in practice.
Therefore, one of the contents focused on in this Draft Law is the regulation on perfecting the organization of the urban government apparatus in Hanoi. This is also a new content compared to the 2012 Capital Law. The Draft Law has devoted a separate chapter to the urban part in Hanoi; in which there are many different mechanisms compared to the current Law on Organization of Local Government.
Specifically in this content, the Draft Law is expected to decentralize more strongly to the People's Council and the People's Committee of Hanoi City to decide on issues related to the organization of the apparatus. For example, strengthening the apparatus for the People's Council, the Standing Committee of the People's Council, and the Committees of the People's Council not only in the cities but also at the district and county levels - where policies are directly implemented, monitored, and implemented...
Along with that is the implementation of decentralization for the city to be proactive in organizing the apparatus of specialized agencies, affiliated administrative organizations and having policies related to the management of cadres, civil servants and public employees; attracting talented people. Policies on payroll, salary and income are also of interest...
With these provisions, the revised Law on the Capital is expected to create conditions for the Hanoi Party Committee and government to have room and advantages in perfecting the government organization. The goal is to undertake and meet the very high requirements of tasks and responsibilities assigned in this Law on the Capital.
National Assembly deputies strongly support the policies of the Law on the Capital (amended), especially the special and specific policies. Because there is only one Capital and there are very special requirements for development and management. Therefore, passing the Law on the Capital (amended) this time will have many advantages.
However, passing the new law is the initial basic step. Because this law is divergent, the work that the Hanoi city government will have to continue to implement is very large. In this Law Project, there are expected to be up to 80 contents of decentralization for the Hanoi city government.
Therefore, the volume of legal documents that need to be issued to concretize policies is still very large. We hope that in the coming time, the Government, central ministries and branches, and especially the Party Committee and the Hanoi City government will focus on researching and proposing specific solutions to effectively implement the policies that have been "paved the way" in the Capital Law.
At the same time, at this session, the National Assembly also gave its opinions on two major planning projects of the Capital. This will be an important legal foundation, creating new position and strength for the Capital in the new period, truly becoming a cultural, civilized, and modern Capital.
Delegate Tran Hoang Ngan (Ho Chi Minh City Delegation): Stronger decentralization for the Capital
The Capital Law (amended) has been carefully prepared and inherited. The city's specific mechanisms have also been identified and approved to be included in the Capital Law.
I support the contents of the Law on the Capital (amended) because it is consistent with the general context of the world, especially the stronger decentralization to the Capital to contribute to promoting initiative and creativity. This is also an orientation in the spirit of the Resolution of the 13th National Party Congress to promote the initiative and creativity of localities, especially Hanoi - the capital of the country.
Therefore, special mechanisms need to be applied to the capital to help Hanoi develop strongly, to be able to stand shoulder to shoulder with the world powers. It is necessary to strongly and completely decentralize the capital to avoid the situation where regulations are already in place but still have to go around many agencies, slowing down the implementation process.
In the context of the world today changing very quickly and unpredictably, stronger decentralization to localities, especially the capital Hanoi, becomes more necessary and urgent.
Delegate Nguyen Tao (Lam Dong Delegation): Attracting quality human resources
The capital is the political and cultural center of the whole country, all the best things must be reserved for the capital because it is the face of the nation. Therefore, this time I hope that the Capital Law (amended) will have more fundamental and comprehensive innovations, a unique feature compared to the characteristics that have been applied.
Through the experience of cities and provinces that have applied special mechanisms, it has been shown that the content is very effective. For example, attracting the most elite human resources, meeting the requirements of sustainable development in the future.
The country's immediate and long-term position also requires policies to train and attract quality human resources. These policies must be decided by competent authorities. The People's Council and People's Committee have the authority to decide on specific mechanisms for themselves in the spirit of autonomy and self-reliance.
Besides, I hope that the Law on the Capital (amended) will also clearly and specifically decentralize to the competent authorities of the capital Hanoi to attract human resources based on experience in urban areas that have been allowed to successfully apply the human resource attraction mechanism in the past.
