Within 30 days from the date of vehicle ownership transfer paperwork, the vehicle owner whose name is on the vehicle registration certificate must complete the license plate revocation procedure.
Car owners will be fined if they do not revoke their license plates.
The Ministry of Public Security has just issued Circular No. 79/2024/TT-BCA effective from January 1, 2025, regulating the issuance and revocation of vehicle registration certificates and license plates of motor vehicles and specialized motorbikes.
Article 6, Clause 5 of the above circular stipulates that when transferring vehicle ownership (including transfer, exchange, donation, inheritance), the vehicle owner must retain the vehicle registration certificate and license plate and not hand them over to the organization or individual receiving the transfer of vehicle ownership.
The owner of the property shall then submit the vehicle registration certificate to the vehicle registration authority when carrying out the repossession procedure. In case of transferring ownership of a vehicle along with the license plate of the auction winning vehicle, the owner of the vehicle shall submit the vehicle registration certificate to the vehicle registration authority when carrying out the repossession procedure.
Next, within 30 days from the date of completing the vehicle ownership transfer paperwork, the vehicle owner whose name is on the vehicle registration certificate must complete the revocation procedure.
If after this deadline the vehicle owner does not carry out the revocation procedure or hand over the vehicle registration certificate and license plate to the organization or individual receiving the transfer of vehicle ownership to carry out the revocation procedure, before resolving the matter, the competent person shall carry out the procedure for handling administrative violations.
According to current regulations, if a vehicle owner does not complete the procedures to revoke the license plate and change the ownership within 30 days, he/she will be fined 3 million VND (for individuals) and 6 million VND (for organizations).
Circular No. 79/2024 also stipulates that when the vehicle owner does not come to complete the recall procedures, the competent authority will draw up a record of administrative violations against the vehicle owner, then impose a penalty according to the provisions of law.
At that time, the organization or individual receiving the transfer of ownership shall sign the administrative violation record as a witness and sign the documents related to the recovery procedure.
After the vehicle registration authority completes the revocation procedures, the organization or individual receiving the transfer of ownership completes the procedures for issuing a vehicle registration certificate and license plate according to regulations.
Notably, according to Circular No. 79/2024, within 7 working days from the date the vehicle expires, the vehicle is damaged and cannot be used, or the vehicle is discarded, the vehicle owner must declare on the Public Service Portal or declare directly at the vehicle registration agency, and at the same time submit the vehicle registration certificate and license plate to the vehicle registration agency or the commune-level police for collection.
When the vehicle registration certificate and license plate have not been revoked in cases where they must be revoked according to regulations, the organization or individual whose name is on the vehicle registration certificate must continue to be responsible as the vehicle owner.
Vehicle registration procedures
Regarding the vehicle registration transfer procedure, Article 17 of Circular No. 79/2024 states that the vehicle owner must first declare the vehicle registration certificate and license plate revocation declaration on the Public Service Portal, provide the route file code or declare the vehicle registration certificate and license plate revocation declaration at the vehicle registration agency.
Next, submit the revocation application and receive an appointment to return the results of the revocation certificate of vehicle registration and license plate according to regulations.
After checking the valid vehicle records, the vehicle registration authority issues 2 certificates of revocation of vehicle registration certificate, license plate with a copy of engine number, chassis number and stamp of the vehicle registration authority on the copy of engine number, chassis number.
For temporarily imported and re-exported vehicles of subjects enjoying diplomatic immunity, 3 copies of the certificate of revocation of vehicle registration certificate and license plate number shall be issued (2 copies shall be returned to the vehicle owner to submit to the customs authority and vehicle registration authority, 1 copy shall be kept in the vehicle file).
In case the vehicle owner has a need, he/she will be granted a temporary vehicle registration certificate along with a certificate of revocation of the vehicle registration certificate and license plate, without having to have a temporary vehicle registration file.
