From April 15, salaries of state-owned enterprise executives are included in the salary fund of employees.

Labor, salary and bonus regimes in state-owned enterprises will be implemented according to new regulations of Decree 44/2025/ND-CP from April 15 and old regulations will be abolished.

Decree 44/2025/ND-CP on labor management, wages, remuneration, and bonuses in state-owned enterprises includes a total of 7 chapters and 34 articles, providing specific guidance on regulations related to labor and wages in state-owned enterprises.

The Decree sets out principles, criteria and methods for organizing and managing labor and wages in state-owned enterprises. This includes determining basic wages, bonuses and other forms of remuneration.

Decree 44/2025/ND-CP stipulates that state-owned enterprises include: Enterprises in which the state holds 100% of the charter capital; enterprises in which the state holds more than 50% of the charter capital or total voting shares.

Decree 44/2025/ND-CP clearly states that enterprises decide on the recruitment and use of labor, build salary scales, payrolls, labor norms, determine salary funds, bonuses and pay salaries and bonuses to employees according to position or job title, ensure appropriate salary and bonus payment, and do not limit the maximum level for experts, talented people, people with high professional and technical qualifications, and who contribute a lot to the enterprise.

The Decree also stipulates the separation of salaries and remuneration of board members and controllers from salaries of the executive board, in which the executive board's salary is calculated together with the employee's salary fund.

For full-time board members and controllers, salaries are determined based on basic salary and additional salary based on scale, complexity of management, production and business efficiency, and efficiency of state capital use.

To implement Decree 44/2025/ND-CP, the Ministry of Home Affairs is seeking comments to complete the Ministry of Home Affairs is drafting a Circular guiding the implementation of labor management, wages, remuneration, and bonuses in state-owned enterprises.

The draft clearly states that the principles of labor management, wages, remuneration, and bonuses for enterprises are implemented according to the provisions of Article 3 of Decree No. 44/2025/ND-CP. The draft also provides instructions on how to calculate labor productivity.

According to the draft, the calculation of the impact of objective factors must be quantified into specific values ​​and figures according to the principle: objective factors that increase labor productivity, profit, and profit margin must be deducted, objective factors that reduce labor productivity, profit, and profit margin must be added to labor productivity, profit, and profit margin when determining wages and remuneration.

The draft also guides enterprises in developing labor plans, recruiting, employing workers, and implementing policies and regimes for employees as prescribed in Article 5 of Decree No. 44/2025/ND-CP.

The draft also provides guidance on the development and promulgation of salary scales, salary tables, and salary allowances; how to determine the salary fund and responsibilities for implementation. When this circular comes into effect, 11 previously issued related circulars will also be repealed.
