However, the defendant still agreed with the results of land price consultation and land price plan developed by the Department of Natural Resources and Environment, in which the comparable assets were not qualified and were not based on the approved detailed planning as the basis for calculating and calculating the price of high-rise buildings using the same method and method of determination as for villas and townhouses.

The former Chairman of the People's Committee of Binh Thuan province also signed and issued a decision approving land prices at the Phan Thiet coastal urban tourism project at a price of more than 2.5 million VND/m2, contrary to legal regulations and the direction of the Provincial Party Committee Standing Committee.

The accusation is that the defendants with different roles intentionally violated their assigned tasks in the process of building and appraising land price plans; agreed to use the results of land price determination, including using comparable assets that did not meet the conditions and had no basis for approved detailed planning as the basis for calculation; calculated the general price of high-rise land such as villa land, townhouses and estimated the total revenue from developing high-rise land from transferring high-rise land area in violation of the law and the direction of the Provincial Party Committee Standing Committee.

Regarding the case, the defendants Nguyen Van Tho, Truong Van Ri and Ho Nhu Hai of the Valuation Consulting Company agreed together to build a Valuation Certificate, in which they used comparable assets that did not meet the conditions, without the basis of the approved detailed planning as the basis for calculating and generalizing the price of high-rise land such as villa land, townhouses and estimating the total revenue from developing high-rise land from the transfer of high-rise land area, not in accordance with the regulations and principles of the surplus method, and were accomplices with the defendants at state management agencies.
