Prosecution of former Minister and Head of the Government Office Mai Tien Dung

On November 30, the Supreme People's Procuracy issued an indictment to prosecute the former Secretary and Chairman of Lam Dong province and related defendants in the case that occurred in Lam Dong province and related units.

Of the 10 defendants in the case, 6 were charged with bribery. They include Mr. Tran Duc Quan, former Secretary of the Lam Dong Provincial Party Committee, and Mr. Tran Van Hiep, former Chairman of the Lam Dong Provincial People's Committee.

In connection with the case, defendant Mai Tien Dung, former Minister and Head of the Government Office, was prosecuted for the crime of Abusing position and power while performing official duties. Defendant Nguyen Cao Tri, General Director of Saigon Dai Ninh Company, was prosecuted for the crime of Bribery.

According to the indictment, due to determining violations of the law in land management, use and construction investment, the Government Inspectorate issued a Conclusion recommending termination of operations and land recovery of the Dai Ninh Project in accordance with the law.

Mr. Mai Tien Dung at the time he was not prosecuted.

After agreeing to buy back the Dai Ninh Project, Nguyen Cao Tri used money and relationships to influence defendants in the Government Office and the Government Inspectorate; colluded, agreed, bribed, and manipulated defendants in the Government Inspectorate and the Lam Dong Provincial Party Committee and People's Committee so that they could take advantage of their assigned positions and powers to commit acts contrary to public service.

The prosecutor concluded that this helped defendant Tri change the inspection conclusion from "terminating operations and reclaiming project land" to "not reclaiming, extending progress and continuing to implement the project", causing particularly serious consequences.

Accordingly, Nguyen Cao Tri repeatedly gave bribes totaling 7.05 billion VND to defendants at the Government Inspectorate, the Provincial Party Committee, and the People's Committee of Lam Dong province related to the Dai Ninh Project so that the defendants could commit violations, helping Tri achieve his goals.

In particular, the defendant Tri gave a total of 750 million VND to the defendants who were members of the Working Group of the Government Inspectorate; colluded and conspired to make the Working Group report in the direction of accepting the petition of Saigon Dai Ninh Company based on valid documents on financial capacity provided by Tri...

Nguyen Cao Tri gave a total of 2.1 billion VND 5 times to Tran Duc Quan (former Secretary of Lam Dong Provincial Party Committee); gave a total of 4.2 billion VND 7 times to Tran Van Hiep (former Chairman of Lam Dong Provincial People's Committee).

Regarding defendant Tran Duc Quan, the Procuracy determined that this defendant received money from Nguyen Cao Tri, directed subordinates to carry out procedures, thereby helping Saigon Dai Ninh Company to extend and delay the progress of the Dai Ninh Project in violation of the law.

Specifically, defendant Quan directed, intervened, and influenced the former Chairman and former Vice Chairman of the Provincial People's Committee in granting the Certificate of Change of Business Registration of Saigon Dai Ninh Company and changing the legal representative.

In addition, the defendant Quan was also the one who influenced to continue to care and direct the implementation, helping Tri complete investment procedures, determine financial obligations, calculate land prices, planning, construction... to implement the Dai Ninh Project.

Regarding defendant Tran Van Hiep, according to the Procuracy, defendant Hiep is the head of the People's Committee of Lam Dong province. Due to his relationship with Nguyen Cao Tri, he received instructions from Tran Duc Quan, and received a total of 4.2 billion VND 7 times to carry out Tri's request.

Regarding the behavior of defendant Mai Tien Dung, the Procuracy determined that although defendant Dung was not in charge of the inspection and handling of petitions, due to his relationship and acquaintance with Nguyen Cao Tri, he received the petition of Saigon Dai Ninh Company from Tri.

Defendant Dung also “signed” and directed subordinates to consult, seek opinions and convey the opinions of leaders on transferring the petition…, contrary to the law. During the implementation process, Mai Tien Dung was given 200 million VND by Tri.

The Supreme People's Procuracy's indictment clearly stated that the defendants' actions in the case caused extremely serious consequences and should be strictly handled according to the law. However, the Procuracy said that it was also necessary to consider mitigating circumstances for the defendants' criminal responsibility.

Specifically, during the investigation and prosecution, the defendants all repented, honestly confessed their crimes and proactively or mobilized their relatives to return the money they had benefited from and remedy the consequences.
