NTN, a second-year student at FPT Polytechnic College in Ho Chi Minh City, recently passed the military draft. N. will join the army on February 26.
N. discussed with the homeroom teacher and the school's Student Service Center to request a leave of absence, and to continue studying after completing his obligation. However, both the homeroom teacher and the Student Service Center asked T. to "register to leave school" in order to reserve his study results.
N. said that there were only a few months left to complete the training program. The school required filling out a withdrawal application form. What if the school did not allow the student to defer? Why did they require students to apply for withdrawal instead of deferring their studies when performing military service?
According to the provisions of Point a, Clause 2, Article 9 of the Regulations on College and Intermediate Training issued in 2022 by the Ministry of Labor, War Invalids and Social Affairs, students mobilized by competent state agencies to perform military service will have their program temporarily suspended and their study results reserved.
The time for retaining learning results is not more than 5 years from the date of stopping the study program and is not counted in the maximum time to complete the course.
Thus, FPT Polytechnic College's request for students to submit an application to withdraw from school is against regulations.
Speaking with Tuoi Tre Online , a representative of FPT Polytechnic College said that because the homeroom teacher did not have full information, he gave incorrect advice to students about retaining their academic results when performing military service.
The student service center received incorrect information from the homeroom teacher and therefore gave incorrect instructions.
"This afternoon, February 20, the school will contact parents and students to complete the necessary procedures to reserve academic results before N. leaves for military service. N.'s academic rights will be guaranteed according to regulations so that students can confidently fulfill their military service," the representative added.
Students are deferred from military service
The 2015 Law on Military Service stipulates temporary deferment of military service for seven groups of citizens, including those studying at high schools, universities, and colleges.
According to point g, clause 1, article 41 of the Law on Military Service on temporary deferment of military service, citizens are granted temporary deferment of military service when studying at a general education institution; being trained at a full-time university level at a university, or at a full-time college level at a vocational education institution during a training course of a training level.
