The problem that Saigon Star International School is facing started in 2018.
Will enforce the judgment
According to Tuoi Tre Online 's investigation, land plot number 94, 811 in Thanh My Loi ward, Thu Duc city (HCMC) belongs to Asia Commercial Bank Debt Management and Asset Exploitation Company Limited (ACBA).
On December 31, 2016, ACBA and Saigon Star Company signed a land lease contract, the lease term is from January 1, 2017 to October 31, 2018.
In October 2018, based on the agreement between the two parties, ACBA and Saigon Star Company signed a land sale contract. However, Saigon Star Company did not make payment as agreed, despite ACBA's repeated requests.
ACBA has filed a lawsuit requesting the court to cancel the land sale contract, forcing Saigon Star Company to hand over the land to ACBA and pay the rent incurred during the period of land occupation.
In January 2020, the People's Court of District 2 conducted a first-instance trial and accepted ACBA's lawsuit. Later, the Ho Chi Minh City People's Court held an appeal trial and did not accept Saigon Star Company's appeal.
On October 12, 2020, the District 2 Civil Judgment Enforcement Office (now the Thu Duc City Civil Judgment Enforcement Office) issued a decision to enforce the judgment requiring Saigon Star Company to return the land to ACBA and pay the rent incurred up to the time of land return.
Because Saigon Star Company submitted a request to review the judgments under the cassation procedure, the enforcement agency temporarily suspended the execution of the judgment. On May 7, 2021, the High People's Court in Ho Chi Minh City issued a cassation decision upholding the appellate judgment.
On May 3, 2024, the Thu Duc City Civil Judgment Enforcement Office issued a decision to enforce the judgment against Saigon Star Company, forcing the return of land to ACBA.
On July 29, 2024, the Thu Duc City Civil Judgment Enforcement Office sent a notice to Saigon Star Company requesting public disclosure of information on the termination of educational activities at the above land.
Accordingly, the school is required to publicly inform workers, teachers, students and students' families that the land will be forcibly returned to ACBA. The school must cease operations at the above address in the 2024-2025 school year and resolve the rights of workers, teachers, students and students' families who are working and studying here.
Recently, the enforcement agency continued to announce that it will organize the forced handover of land in December 2024.
Saigon Star students don't know where to go?
Ms. G. (whose child is studying at Saigon Star International School) said that on October 31, 2024, when the enforcement force came to post the notice about the forced handover of land in December 2024, the parents just learned about this news.
According to Ms. G., the school did not inform parents many months ago, even though this is extremely important information directly related to the rights of students. This makes many parents passive. Tomorrow (December 13) is the last day of school. All students will be off until February 12, 2025.
School representatives said students will return to school on February 12, 2025 at campus number 577 National Highway 13, Hiep Binh Phuoc Ward, Thu Duc City.
However, according to Ms. T. (whose child studies at the school), the schedule to welcome students back to the new facility on February 12, 2025 is very difficult to implement, because the land at 577 National Highway 13 of the school is currently almost "empty".
The school has about 300 students.
