In order to promptly implement policies and regimes for cadres, civil servants, public employees, commune-level cadres and public employees, and laborers (hereinafter referred to as cadres, civil servants, public employees and laborers) in the implementation of organizational restructuring of the apparatus and administrative units according to the provisions of Decree No. 178/2024/ND-CP; Circular No. 01/2025/TT-BNV, the Chairman of the Provincial People's Committee has just signed and issued Document No. 290/UBND-TCDNC, dated February 13, 2025 on the implementation of Decree No. 178/2024/ND-CP dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, laborers and armed forces in the implementation of organizational restructuring of the political system.
Accordingly, the Provincial People's Committee requests heads of agencies, organizations, units, and localities (hereinafter referred to as agencies and units) to urgently implement Decree No. 178/2024/ND-CP; Circular No. 01/2025/TT-BNV, focusing on implementing the following contents:
Disseminate information on the implementation of regimes and policies according to the provisions of Decree No. 178/2024/ND-CP; Circular No. 01/2025/TT-BNV to all cadres, civil servants, public employees, and employees under the management of agencies and units subject to rearrangement and reorganization according to the direction of the Central and the province so that cadres, civil servants, public employees, and employees clearly understand the regimes and policies in the implementation of rearrangement of the apparatus and administrative units according to the regulations of the State.
Party committees and heads of agencies and units shall develop and promulgate specific criteria for evaluating cadres, civil servants, public employees, and workers to implement the arrangement and resolution of policies and regimes; at the same time, review the overall quality of cadres, civil servants, public employees, and workers under their management. Based on the evaluation results of the last 3 years and the specific criteria of the unit, decide and make a list of subjects who must resign and cases with voluntary resignation requests due to organizational arrangement (if not agreed, a written response must be given stating the reason) to reduce the payroll (ensuring a minimum reduction of 20% of civil servants and public employees receiving salaries from the state budget according to the arrangement and streamlining plan), and restructure to improve the quality of cadres, civil servants, and public employees.
Annually develop a plan to implement policies and regimes (including the number of subjects, subsidy amount and leave time for each subject) for the following year and report to the Provincial People's Committee (through the Department of Home Affairs and Department of Finance) for synthesis.
Make a list of subjects implementing policies and regimes and estimate the subsidy amount for each subject to submit to the Provincial People's Committee for approval (through the Department of Home Affairs and the Department of Finance). After being approved by the Provincial People's Committee, promptly pay policies and regimes to cadres, civil servants and public employees in accordance with the provisions of law.
When resolving policies and regimes that are not in accordance with regulations, the head of the agency or unit directly managing the subject must be responsible for notifying the social insurance agency and relevant agencies to stop paying policies and regimes to the subject that are not in accordance with regulations; be responsible for recovering the allowances that have been granted to that subject. Consider handling the responsibilities of relevant individuals; and at the same time be responsible according to the provisions of law for the improper implementation of regulations on policies and regimes for cadres, civil servants, public employees, and workers in the implementation of organizational arrangement.
The Department of Home Affairs guides agencies and units to prepare dossiers; appraise dossiers of subjects (including: determining subjects entitled to policies and regimes; time of benefit), synthesize the list and budget provided by the Department of Finance to submit to the Provincial People's Committee for approval. Coordinate with the Department of Finance to synthesize and draft a report of the Provincial People's Committee to report to the Ministry of Home Affairs and the Ministry of Finance on the results of implementing policies and regimes for cadres, civil servants, public employees and workers in the implementation of organizational restructuring.
The Department of Finance guides agencies and units to prepare budget estimates for implementing policies and regimes; appraises budgets for each subject and sends them to the Department of Home Affairs for synthesis and submission to the Provincial People's Committee for approval. Advises on budget arrangements for implementing policy and regime payments according to regulations.
The Provincial Radio and Television Station, Ha Nam Newspaper, and the Provincial Electronic Information Portal shall strengthen the dissemination of policies and regimes for cadres, civil servants, public employees, and workers in the implementation of the organizational arrangement of the political system as prescribed in Decree No. 178/2024/ND-CP of the Government.
During the implementation process, if there are any problems beyond the authority to resolve, agencies and units shall promptly report to the Provincial People's Committee (through the Department of Home Affairs and the Department of Finance) for consideration and guidance on resolution.
