On the afternoon of November 28, with 386 delegates participating in the vote in favor (accounting for 78.14%). The National Assembly officially passed the Law on Forces Participating in Protecting Security and Order at the Grassroots Level.
Previously, reporting on the explanation, acceptance and revision of the draft Law on Forces Participating in Protecting Security and Order at the Grassroots Level, Chairman of the National Defense and Security Committee Le Tan Toi said that regarding the scope of regulation, the National Assembly Standing Committee (NASC) has directed the review and addition of a number of independent tasks of this force in Articles 7, 8, 10 and 12 of the draft Law to demonstrate the authority associated with the tasks and responsibilities of this force when performing independent tasks.
Regarding the principles of organization, operation, working relations, coordination, and support in organization, operation, and task implementation, the Standing Committee of the National Assembly would like to accept and revise Clause 2, Article 4 and related provisions in Article 3 and Clause 1, Article 5 of the draft Law to clearly define that the forces participating in protecting security and order at the grassroots level are under the "comprehensive" leadership of the Party Committee, and the management, "direction, and operation" of the People's Committee at the commune level.

Regarding the tasks of the forces participating in protecting security and order at the grassroots level, the Standing Committee of the National Assembly has directed the research, review, supplementation and revision of the contents of regulations on the tasks of the forces participating in protecting security and order at the grassroots level, not overlapping with the general tasks of the Commune-level Police, consistent with relevant regulations in the legal system.
At the same time, clearly define the joint responsibility of the Commune-level Police as: "The Commune-level Police are responsible for performing the tasks of the force participating in protecting security and order at the grassroots level according to the provisions of law".
Review and supplement a number of independent tasks suitable to the position and function of the force participating in protecting security and order at the grassroots level in Clause 2, Article 7, Clause 2, Article 8 and Clauses 2 and 3, Article 10 of the draft Law submitted to the National Assembly for approval in order to maximize the role of this force and improve the effectiveness of security and order protection work at the grassroots level.
Regarding the selection criteria for participating in the force to protect security and order at the grassroots level, Mr. Toi said that the Standing Committee of the National Assembly has accepted and directed the study, supplementation and specific adjustment in Article 13 of the draft Law submitted to the National Assembly for approval to clearly stipulate the criteria and conditions for participation from 18 to 70 years old. In case of being over 70 years old and in good health, the Chairman of the People's Committee at the commune level shall consider and decide based on the proposal of the Commune-level Police;
Amend the regulation that the educational level is having a diploma or having completed secondary school education or higher.
For border areas, islands, mountainous areas, areas with especially difficult socio-economic conditions, and ethnic minority areas, people who have completed primary education can be recruited.

Regarding ensuring the operating conditions of the forces participating in protecting security and order at the grassroots level, Mr. Toi said that after receiving a request from the Standing Committee of the National Assembly, the Government issued Report No. 518 dated October 6, 2023 assessing the impact on staffing, funding and conditions for ensuring the forces participating in protecting security and order at the grassroots level.
According to the Government's report, with the establishment of the Security and Order Protection Team and the estimated budget, there will be no increase in the number of participants and no increase in the total budget compared to current practice. Members of the National Assembly Party Delegation agree with the content of the Government's explanation. Therefore, the National Assembly Standing Committee proposes that the National Assembly keep the draft Law as approved.
Some opinions suggest regulating the monthly support level, the compensation level for this force or regulating the framework by region. Some opinions say that this is a voluntary, self-governing force established by the community, so the community contributes to pay for it, and the State budget cannot be used.
Mr. Toi said that according to the Standing Committee of the National Assembly, if the Law stipulates "rigid" regulations on the monthly regular support level, the compensation level and/or the minimum support level for this force, it will not be suitable to reality, especially in localities with economic difficulties, and it may put pressure on the budget for localities that are not yet financially independent.
Therefore, the Standing Committee of the National Assembly proposed to inherit the current law, regulate in an open direction for local authorities to decide on the level of regular monthly support, decide on the level of support for voluntary social insurance and health insurance contributions for people participating in the force participating in protecting security and order at the grassroots level to suit the actual conditions in each locality and ensure the feasibility of the Law .
