On November 28, at the conference to review and evaluate electronic information activities in 2024 and orientations for 2025 organized by the Ministry of Information and Communications (MIC), the leaders of the Department of Radio, Television and Electronic Information disseminated many new points in Decree 147/2024/ND-CP regulating the management, provision and use of Internet services and online information issued by the Government on November 9.
Provide information of service users in Vietnam upon request
At the Conference, Mr. Le Quang Tu Do - Director of the Department of Radio, Television and Electronic Information disseminated new regulations in Decree 147 on: Foreign organizations, enterprises and individuals providing cross-border information to Vietnam.
Accordingly, cooperation agreements on content between foreign organizations, businesses and individuals providing cross-border information with Vietnamese press agencies must include the following basic information: Agreement term; scope, content used and responsibilities of each party; method/form of payment of benefits.
In case the two parties cannot reach a cooperation agreement, foreign organizations, enterprises and individuals providing cross-border information may not use or display information cited from Vietnamese press agencies.
Mr. Le Quang Tu Do said that organizations providing cross-border information need to store information of service users from Vietnam when registering for social network accounts, including: Full name, date of birth, mobile phone number in Vietnam (or personal identification number).
"Provide information of service users in Vietnam to the Ministry of Information and Communications, the Ministry of Public Security, and competent authorities upon request," Mr. Le Quang Tu Do emphasized.
According to Mr. Le Quang Tu Do, in the new regulation, foreign organizations and individuals must authenticate the accounts of social network service users using mobile phone numbers in Vietnam. Only in cases where users confirm that they do not have a mobile phone number in Vietnam, foreign organizations, businesses and individuals providing social network services must authenticate accounts using personal identification numbers in accordance with the law on electronic identification and authentication.
In case a social network service user uses the livestream feature for commercial purposes, foreign organizations, businesses, and individuals providing social network services must authenticate their accounts using personal identification numbers in accordance with the law on electronic identification and authentication.
In case users of social networking services use the livestream feature, they must authenticate their accounts with personal identification numbers according to the provisions of law on electronic identification and authentication. Ensure that only authenticated accounts are allowed to post information (write articles, comment, livestream) and share information on social networks.
Must be responsible for classifying and displaying warnings about content that is not suitable for children; Implement solutions to protect children in the online environment according to the provisions of the law on child protection.
Within 48 hours of receiving a complaint from a service user in Vietnam about content that violates Article 8 of the Law on Cyber Security, foreign organizations, enterprises, and individuals providing cross-border information must block and remove content, services, and applications that violate the law.
"Temporarily and permanently block accounts, community pages, community groups, and content channels from being accessed by users in Vietnam within 24 hours of the request. Be responsible for promptly preventing and removing content that violates national security within 24 hours," said the Director of the Department of Radio, Television and Electronic Information.
General electronic information page linked to electronic newspaper does not exceed 50% of total news
According to Deputy Director of the Department of Radio, Television and Electronic Information Nguyen Thi Thanh Huyen, Decree 147 stipulates that general electronic information pages can only post news 1 hour later than the original news; and take news sources from at least 3 press agencies.
"General electronic information pages linked to electronic newspapers are only allowed to produce articles on certain fields. Electronic newspapers must be responsible for the content of the links; the ratio of linked articles must not exceed 50% of the total number of articles of the press agency in 1 month. Do not use domain names or page names that cause confusion with the press; do not allow users to comment on articles on the general electronic information page," Ms. Huyen emphasized.
Social networks are not allowed to arrange members' posts into fixed categories; do not post or write articles in the form of reports, investigations, interviews and post them on social networks.
For organizations and businesses that are not press agencies, the string of characters that make up the domain name must not be similar or identical to the name of the press agency, and must not use words that can be confused with a press agency.
Regarding sanctions, Ms. Nguyen Thi Thanh Huyen said that Decree 147 stipulates a 3-month suspension of operations in the following cases: General news websites that violate content twice; Failure to comply with the responsibilities of service providers and failure to meet the operating conditions as prescribed; Failure to carry out procedures to request a social network license within 60 days from the date the Ministry of Information and Communications issues a written notice.
License revocation in the following cases: Failure to block and remove content as requested by the management agency; Failure to take corrective measures after a 3-month suspension period; Organizations and businesses that have issued written notices of cessation of operations/not providing services after a 12-month period.
For the provision of online electronic game services, the regulation does not grant licenses for simulation games such as those in casinos, games using card images to limit negative impacts on players. Requires player authentication by mobile phone number in Vietnam, ensuring that only authenticated accounts can participate in playing games...
