On August 30, 2024, the City People's Committee issued Decision No. 4815/QD-UBND approving the marine aquaculture plan in Mong Cai City. The objective of the plan is to provide orientations, plans and appropriate and synchronous development solutions to turn marine aquaculture into an important economic sector, bringing high economic efficiency, being environmentally friendly and developing sustainably. This plan is the basis for arranging, assigning and leasing sea surface to organizations and individuals with aquaculture needs and attracting investment in the marine aquaculture sector; improving the effectiveness of state management of aquaculture activities.
Accordingly, the total area approved according to the plan is 5,300 hectares. Including: The area within 3-6 nautical miles to attract investment has a total area of 3,624.7 hectares in Vinh Trung and Vinh Thuc communes (Vinh Trung commune: 2,300 hectares; Vinh Thuc commune: 1,324.7 hectares) has been planned at a scale of 1/2,000. The area within 3 nautical miles and in the dry tide has been planned at a detailed scale of 1/500 with a total area of 675.3 hectares in 6 communes and wards with 353 farming plots. Specifically: Quang Nghia commune has 1 farming area with an area of 30 hectares arranged with 19 farming plots; Hai Tien commune has 1 farming area with an area of 84 hectares arranged with 41 farming plots; Hai Dong commune has 1 farming area with an area of 260 hectares arranged with 134 farming plots; Van Ninh commune has 2 farming areas with a total area of 110 hectares arranged with 53 farming cells; Hai Hoa ward has 3 farming areas with a total area of 115.3 hectares arranged with 67 farming cells; Tra Co ward has 1 farming area with an area of 76 hectares arranged with 39 farming cells.
Mong Cai City also proposed the Provincial People's Committee to expand the development to serve aquaculture, which is proposed to be integrated into the province's aquaculture planning of 1,000 hectares in Hai Dong and Vinh Trung communes (Hai Dong commune: 368 hectares; Vinh Trung commune: 632 hectares) with a scale plan of 1/2000.
After the plan was approved, Mong Cai City posted it on the city's electronic information portal and at the People's Committees of communes and wards; assigned agencies, units, communes and wards to coordinate in implementing the allocation of sea surface according to Decree No. 11/2021/ND-CP dated February 10, 2021 of the Government. In particular, areas within 3 nautical miles will allocate sea areas of 1 hectare or less to individuals for aquaculture according to the provisions of Point a, Clause 2, Article 44 of the Law on Fisheries; for areas within 3 to 6 nautical miles, the Provincial People's Committee will decide to allocate sea areas of 1 hectare or less according to specific regulations. The city has assigned specific tasks to functional departments, offices and communes and wards to specify the content of the plan, and propagate to people to implement the allocation and lease of land and water surface for aquaculture. By March 31, 2025, the Department of Natural Resources and Environment had appraised and submitted to the City People's Committee 17 applications for land allocation with coastal water surface and sea areas to individuals for aquaculture, including 15 applications for land allocation with coastal water surface and 2 applications for sea areas.
Mr. Le Van Cuong, Head of the Department of Natural Resources and Environment of Mong Cai City, said: Currently, the implementation of the aquaculture project in the city is facing difficulties. According to the 2024 Land Law, the form of leasing land to individuals who are not directly involved in agricultural production for aquaculture purposes has not been clearly regulated on the form of leasing land without auctioning land use rights or leasing land through auctioning land use rights. Therefore, the Department of Natural Resources and Environment has advised the City People's Committee on Document No. 665/UBND-VP dated March 20, 2025 to ask for opinions from the Department of Agriculture and Environment on the difficulties in leasing land with coastal water surface for aquaculture purposes to individuals according to the aquaculture project at sea in Mong Cai City. Based on the guidance of the Department of Agriculture and Environment, the Department of Natural Resources and Environment will advise the City People's Committee to lease land with coastal water surface for aquaculture purposes according to regulations. The city strives to complete the allocation of coastal land and sea areas to individual aquaculture operators according to the approved plan by April 2025.
