Ho Chi Minh City recommends continuing to improve mechanisms, policies and laws on preventing and combating corruption and negativity.

On behalf of the Ho Chi Minh City People's Committee, Permanent Vice Chairman of the City People's Committee Duong Ngoc Hai reported on the topic "Prevention, detection and handling of corruption."

Along with the socio -economic development, in the past 5 years, the fight against corruption and negativity has been identified by the Ho Chi Minh City Party Committee and People's Committee as a key, long-term task, contributing significantly to the socio-economic development of the City; the City Party Committee and People's Committee have led and directed the implementation resolutely, regularly, continuously, without rest, without subjectivity or negligence.

With the motto: "prevention is fundamental and long-term; detection and handling are important, urgent and breakthrough; closely combining prevention, detection and handling of corruption and negative acts"; always closely following the Party's guidelines and policies and the State's laws, especially the conclusions and directions of the Central Steering Committee on preventing and combating corruption and negative acts to promptly lead and direct serious, effective and appropriate implementation in accordance with the local situation; agencies, organizations and units in the City have seriously and synchronously implemented solutions to prevent corruption and negative acts and achieved some results.

Regarding the implementation of regulations on corruption and negativity prevention: The city has carried out propaganda, dissemination and education on anti-corruption laws; publicity and transparency in the organization and operation of agencies, organizations and units; development and implementation of norms, standards and regimes; implementation of codes of conduct for people with positions and powers; implementation of job transfers for people with positions and powers; implementation of administrative reforms, application of science and technology in management and non-cash payments; implementation of regulations on asset and income control;...

Regarding the work of detecting and handling corruption in the City: The results of detecting and handling corruption through internal monitoring, inspection and self-inspection activities have detected and handled 14/16 cases of violations related to corruption through internal inspection at units. Through inspection work, 04 cases and 19 people related to corruption have been detected and handled.

Regarding the handling of cases, from July 2019 to June 2024, the Ho Chi Minh City Police Investigation Agency has handled 211 cases, 562 defendants on corruption charges. The People's Procuracy has prosecuted 132 cases with 453 defendants. The City People's Court has tried 133 cases with 257 defendants, including many particularly serious cases monitored and directed by the Central Steering Committee for Anti-Corruption and the City Steering Committee for Anti-Corruption.

Asset recovery also achieved positive results. Recovery during the investigation phase reached over 3,300 billion VND; during the prosecution and trial phase reached over 17,700 billion VND; during the execution phase reached nearly 60,000 billion VND.

In terms of advantages, the Ho Chi Minh City Party Committee and People's Committee have been focusing on leading and directing agencies, units and localities to seriously, effectively and synchronously implement solutions to prevent corruption and negativity, without forbidden areas or exceptions; gradually perfecting strict prevention mechanisms; strengthening leadership and direction in concretizing the Party's guidelines and policies, the State's policies and laws on the prevention and fight against corruption and negativity; solutions to prevent corruption and negativity are comprehensively implemented. Authorities at all levels have proactively developed and implemented programs and plans on the prevention and fight against corruption and negativity in accordance with the characteristics and situation of localities, agencies and units. The work of preventing and fighting corruption has achieved many important results, contributing to improving the effectiveness and efficiency of state management.

Regarding the existence, Permanent Vice Chairman of the City People's Committee Duong Ngoc Hai said that corruption and negative behavior are increasingly sophisticated, complicated and difficult to detect. The work of detecting and handling corruption is not the end of the corruption situation.

Most of the corruption, economic and position cases discovered and handled in the past in Ho Chi Minh City have occurred over a long period of time, so they are very complicated, with many people involved, uncooperative subjects, and a huge volume of files, so thoroughly handling the cases is an extremely difficult problem.

Propaganda and education work on preventing and combating corruption and negativity has not focused on prevention; has not been organized regularly and continuously, and lacks depth.

The work of self-inspection, internal supervision, self-reflection, self-correction, and raising the responsibility of leaders in some places has not received due attention, so corruption and negativity have not been prevented in a timely manner.

In addition, some of the Party's guidelines and policies have not been institutionalized and issues arising in practice have no regulations to regulate or the regulations are unclear, there are many different interpretations, but there are no guiding documents, leading to difficulties in applying the law.

To overcome the above limitations and shortcomings, the Ho Chi Minh City People's Committee recommends that the Government Inspectorate continue to improve mechanisms, policies and laws on preventing and combating corruption and negativity; institutionalize the contents of the Party's guidelines and policies on preventing and combating corruption and negativity.

Regarding the verification of assets and income, Ho Chi Minh City recommends that a Circular be issued regulating the procedures for conducting asset and income control; in which, it is necessary to specify the functions, tasks, and authority of the asset and income control agency; at the same time, there should be specific regulations for each act of dishonest declaration and explanation of additional assets and income; acts of incomplete and unclear declaration;...

The city also recommends early construction and completion of a national database system on centralized and unified asset and income control, ensuring strict management, while at the same time having coordination and sharing of information and data among asset and income control agencies.

For enterprises and organizations in the non-state sector, it is necessary to issue a Circular regulating the order and procedures for inspection and examination of the responsibility for implementing anti-corruption laws in enterprises and organizations in the non-state sector as well as providing general and unified guidance on internal control in enterprises and organizations in the non-state sector.
