Ho Chi Minh City seeks opinions on short-term accommodation model in apartments

Ho Chi Minh City is seeking opinions from relevant units on proposals for the operation of short-term accommodation models in apartment projects.

The Ho Chi Minh City Department of Construction has just sent a document to the Department of Tourism, the Ho Chi Minh City Real Estate Association and the People's Committees of districts to give comments and proposals on the operation of short-term accommodation models in apartment buildings in the area.

According to the Department of Construction, this unit received an official dispatch from the Office of the Ho Chi Minh City People's Committee regarding the short-term accommodation model in apartment buildings. The official dispatch assigned the Department of Construction to preside over and coordinate with relevant units, based on the Housing Law and the resolution on specific mechanisms for the city's development, to assess the actual situation of managing short-term accommodation models in apartment buildings.

The goal is to ensure security and safety for residents living in the apartment building, while also researching and recommending mechanisms for economic and tourism development to report and propose to the Ho Chi Minh City People's Committee for consideration.

According to the Department of Construction, the 2023 Housing Law stipulates that acts of arbitrarily converting functions and using apartments for purposes other than residence are strictly prohibited.

Circular 05 of the Ministry of Construction also stipulates that short-term accommodation models in apartment buildings can only be implemented in projects with mixed-use purposes or projects licensed to operate tourist accommodation services.

However, in order to have a basis for proposing and recommending the Ho Chi Minh City People's Committee to consider and direct the mechanism for economic and tourism development, the Department of Construction requests the Department of Tourism, the Ho Chi Minh City Real Estate Association, the Thu Duc City People's Committee and the People's Committees of districts to give comments on the operation of the short-term accommodation model in apartment buildings in the area.

Previously, the Ho Chi Minh City People's Committee issued Decision 26/2025 regulating the management and use of apartment buildings in the city, including regulations on not using apartment buildings for purposes other than residence.

Pursuant to this regulation, localities and management boards of apartment buildings have tightened the business model of short-term accommodation rental services through platforms such as Airbnb, and many apartment buildings even do not allow this service to operate.

Meanwhile, experts suggest that there should be a pilot mechanism for Airbnb services in apartment buildings and contribute to promoting tourism.
