Newly established company wins bid for billion-dollar land plot after 40 days
On October 29, 2021, the People's Committee of Quang Ninh province issued Decision No. 3787/QD-UBND approving the investment policy of the urban area project in Area 10B, Quang Hanh Ward, Cam Pha City. The form of selecting investors for this project is auctioning land use rights in accordance with the provisions of the law on land.
The project investment capital is 1,232 billion VND, from non-state budget sources. The total area of land, water surface, and implementation site is 318,210.9m2.
The residential construction floor area is 229,303.4m2 with 451 townhouses and villas, built up to 7 floors high. This project will have a population of 2,024 people.
On December 30, 2021, the People's Committee of Quang Ninh province issued Decision No. 4720/QD-UBND on recognizing the results of the auction of land use rights to implement the urban area project in area 10B. The winning bidder was Do Gia Capital Company Limited. At the time of winning the bid, this company had just been established for more than 40 days, with Mr. Tran Hoai Thanh as director.
On June 15, 2023, the People's Committee of Quang Ninh province issued Decision No. 1614/QD-UBND approving the results of the appraisal of the environmental impact assessment (EIA) report of the urban area project in area 10B of Do Gia Capital Company Limited.
This Decision clearly states that the approval of the project's EIA is the basis for competent state agencies to inspect, examine and supervise the implementation of environmental protection requirements. In particular, the Department of Natural Resources and Environment of the province is fully responsible before the law and the Provincial People's Committee for the reasonableness, legality and accuracy of information and data of the approved EIA content.
Cam Pha City People's Committee must take full responsibility before the law and the Provincial People's Committee for the content of the planning approval and the project implementation process to ensure compliance with current regulations.
On September 19, through coastal environmental monitoring, the Ha Long Bay Management Board found that the urban area project in area 10B was dumping soil directly, without embankment, into the sea area belonging to the buffer zone of the world natural heritage Ha Long Bay, protection zone 2 of the special national monument Ha Long Bay.
Regarding this, the Ha Long Bay Management Board has sent a document requesting the Department of Natural Resources and Environment of the province, the Department of Culture and Sports of the province, and the People's Committee of Cam Pha City to inspect and request construction units to comply with the provisions of the law on environmental protection and heritage protection. At the same time, there are solutions to prevent substances that pollute the environment and ecology of Ha Long Bay.
On October 6, the provincial Department of Construction issued a document requesting Do Gia Capital Company Limited to comply with the design documents and construction permits that have been appraised and granted; to take appropriate construction measures to ensure water circulation in the mangrove and coral reef areas on both sides of Highway 1; and to minimize impacts on the overall landscape and environment of the world natural heritage Ha Long Bay.
Reasons why the project was "whistled"
On November 6, after the press and public opinion reflected on the above urban area project, acting Chairman of the People's Committee of Quang Ninh province Cao Tuong Huy said that he immediately issued a document directing an inspection to take measures according to his authority.
On the same day, the interdisciplinary delegation of Quang Ninh province had a working session on the inspection of feedback related to the construction of the urban area project in area 10B.
Accordingly, the project owner has not properly implemented the contents of the environmental impact assessment (EIA) report approved by the Provincial People's Committee.
Specifically, the following measures have not been implemented: The inside of the service road and the cofferdam has a geotextile layer; dredging the mud underneath before construction; dredging the mud that rises during construction; implementing the entire cofferdam combined with treating the foundation of the surrounding embankments or segments for implementation, but must create closed areas to prevent mud from rising, rainwater from carrying mud and soil out to sea; periodically monitoring water quality, sediment, and biodiversity in the project implementation area and Ha Long Bay heritage site with a frequency of 3-6 months/time; publicly disclosing the EIA report at the ward and at the project.
At the time of inspection, the investor had not yet presented the construction site and construction method documents, and had not yet reported to the People's Committee of Cam Pha City for consideration and approval according to the opinion of the Provincial Department of Construction stated on page 2 of Construction Permit No. 82/GPXD-SXD dated July 24, 2023. The project owner's construction diary was incomplete for the construction of the official road...
Also on November 6, Chairman of Cam Pha City People's Committee Nguyen Manh Cuong signed a document requesting Do Gia Capital Company Limited to stop construction of the urban area project in area 10B.
