US Supreme Court declares Trump immune from prosecution

The justices, in a 6-3 ruling led by Chief Justice John Roberts, threw out a lower court's decision on federal criminal charges related to his efforts to overturn his 2020 election loss to Joe Biden.

“We conclude that under our constitutional separation of powers, the nature of presidential power requires that former presidents have some immunity from criminal prosecution for official acts performed while in office,” Roberts wrote.

Mr. Trump is the Republican candidate running against Mr. Biden of the Democratic Party in the US election on November 5, and is considered to have a high chance of winning to return to the White House later this year.

Mr Trump, 78, hailed the ruling in a social media post: "A big win for our Constitution and our Democracy. Proud to be an American!" He is the first former US President to be criminally prosecuted and the first former President to be convicted of a crime, even facing four separate criminal cases.

The ruling marks the first time since the nation's founding in the 18th century that the Supreme Court has declared that former presidents can be protected from criminal charges in all cases.

The Supreme Court has handed down two other rulings in Trump’s favor this year. In March, it barred the state of Colorado from disqualifying him from the primary. And last week, it acquitted him of criminal charges in a lawsuit seeking to overturn the election results and charges related to the Capitol riot.

One of Trump’s four criminal cases has already gone to trial in New York, where he was found guilty by a Manhattan jury on May 30 of falsifying documents to conceal a “hush money” payment to an adult film star. Trump has pleaded not guilty in all of the cases against him.

The criminal cases against Mr. Trump do not preclude him from running for reelection this year, nor does he stand a chance of returning to the White House. In fact, if he were to regain the presidency, he could personally end the prosecution of himself or pardon himself for any federal crimes.
