Calculate practice time for medical practice license

Mr. Huy studied Decree No. 96/2023/ND-CP, Article 143 stipulates transitional provisions for practice, practice certificates and conversion of practice certificates that have been granted under the provisions of the Law on Medical Examination and Treatment No. 40/2009/QH12. However, when he asked the Department of Health, he was told that only Article 129 on conditions for medical examination and treatment practice would be applied to issue new practice licenses.

Mr. Huy asked, in his case, can Article 143 of Decree No. 96/2023/ND-CP be applied to apply for a license to practice a specialty?

Regarding this issue, the Ministry of Health responded as follows:

Currently, practitioners who are granted a practice license are subject to the provisions of Clause 1, Article 143 of Decree No. 96/2023/ND-CP dated December 30, 2023 of the Government, and at the same time, the provisions of Clause 5, Article 129 of this Decree are also applied in cases where they have practiced before January 1, 2024, specifically as follows:

"b) Calculate the practice time before January 1, 2024 to calculate the total practice time but must ensure that the practice time as prescribed in Article 3 of this Decree is achieved before December 31, 2024".
