Standards for the titles of Department Director, Deputy Department Director and equivalent according to new regulations of the Government

The Government has just issued Decree No. 29/2024/ND-CP stipulating standards for titles of leadership and management civil servants.

PROFESSIONAL STANDARDS, POLITICS, STATE MANAGEMENT, FOREIGN LANGUAGES

The Government clearly stipulates standards applicable to leadership and management at all levels; including standards for the positions of Director, Deputy Director of Department and equivalent.

Accordingly, the positions of Director, Deputy Director of Department and equivalent must meet the general standards applied to civil servant leadership and management positions in terms of political ideology; ethics, lifestyle, and sense of organization and discipline.

Regarding professional qualifications, the above positions require a university degree or higher appropriate to the industry and field of work as prescribed by competent authorities.

Regarding political theory, the person holding the position of department director and equivalent includes: Department Director, Chief of Office of the National Assembly Delegation and People's Council, Chief of Office of the Provincial People's Committee, Provincial Inspector, Head of the Ethnic Minorities Committee must have a Bachelor's degree in Politics or Advanced Political Theory or Advanced Political - Administrative Theory or have a certificate of equivalent to the Advanced Political Theory level from a competent authority.

Deputy Directors of Departments, Deputy Chief of Office of the National Assembly Delegation and People's Council, Deputy Chief of Office of the Provincial People's Committee, Deputy Chief Inspector of the province, Deputy Head of the Ethnic Committee must have a diploma of Intermediate Political Theory or higher or have a certificate of equivalent to Intermediate Political Theory level from a competent authority.

Regarding state management, Department Directors and equivalents need to have certificates of training in state management knowledge and skills for civil servants at senior specialist level and equivalent.

The person holding the position of Deputy Director of a Department or equivalent must have a certificate of training in knowledge and skills of state management for civil servants at the senior specialist level or equivalent or higher.

Regarding foreign language proficiency, Decree 29/2024 clearly states: “Having foreign language proficiency appropriate to the leadership and management position according to the regulations of the ministry, branch, and locality where the employee works, or being able to use ethnic minority languages ​​in cases where the job position is directly related to ethnic minorities or the job position is in an ethnic minority area. Determining foreign language proficiency and cases where diplomas and certificates are determined to be equivalent shall be implemented in accordance with the provisions of law”.

In addition, regarding general standards, Decree 29/2024 also requires meeting specific standards on capacity and reputation; health, age, and work experience.

Notably, regarding the provisions on practical experience and appropriate working time, Decree 29/2024 clearly stipulates:

In case of appointment from local human resources: In case the working agency or organization has a constituent unit: Ensure that the employee has held a leadership or management position or title of the constituent unit; the time holding the current position or title or the equivalent position or title adjacent to the expected appointment position or title is at least 2 years (24 months), if not consecutive, it can be accumulated (only accumulated for the time holding the equivalent position or title);

In case the working agency or organization does not have a constituent unit: Ensure continuous working time in the industry or field corresponding to each specific position and title according to regulations.

In case of appointing personnel from external sources: In case the working agency or organization does not have a constituent unit: Ensure continuous working time in the industry or field corresponding to each specific position and title according to regulations;

In case the agency or organization currently working has a constituent unit and the appointment is expected at an agency or organization without a constituent unit: Ensure that the time holding the position or title equivalent to the position or title expected to be appointed is also at least 2 years (24 months).

In case the agency or organization currently working has a constituent unit and is expected to be appointed at the agency or organization with the constituent unit: Ensure the time holding the position or title equivalent to the position or title expected to be appointed is at least 2 years (24 months) or ensure continuous working time in the industry or field corresponding to each specific position or title according to regulations.

SPECIFIC STANDARDS

In addition to the above general standards, Decree 29 stipulates specific standards for each position.

Accordingly, the Director of a Department and equivalent is the head of the Department, leading, managing and organizing the implementation of state management functions and tasks in the sector and field in the province or centrally-run city and performing other tasks assigned by competent authorities; directly responsible to the Provincial People's Committee, Chairman of the Provincial People's Committee, and at the same time responsible for state management of the sector and field before the Minister of the Ministry managing the sector and field and before the law for assigned responsibilities and tasks.

In addition to meeting the general standards, Department Directors and equivalents must meet the following requirements:

Deep understanding of state management, legal knowledge of the industry, management field and specific regulations applicable locally;

Ability to: Advise and direct the effective implementation of central legal documents; advise on the development of legal documents on sectors and fields applicable in the locality; direct the development of term and annual work plans of sectors and fields in the locality; direct or directly resolve difficult and complicated issues in sectors and fields in the locality; implement administrative reforms, public service regimes, and civil servants in the locality; direct the implementation of inspections, checks, and handling according to the provisions of law; direct the resolution of recommendations, complaints, and denunciations of organizations and citizens under its authority; advise and lead the implementation of coordination work with central agencies; direct the synchronous, unified, and effective implementation of the Party's guidelines, policies, and laws within the province;

Currently holding the position of Deputy Director of the Department and equivalent or equivalent position and title according to regulations of competent authorities according to the decentralization of cadre management.

The Deputy Director of the Department and equivalent are the deputies of the Director of the Department, assisting the Director of the Department in managing and organizing the implementation of one or several areas of work within the functions and tasks of the Department, and are responsible to the Director of the Department and before the law for the assigned responsibilities and tasks.

In addition to meeting the general standards, Deputy Directors of Departments and equivalents must meet the following regulations:

Deep understanding of state management, legal knowledge of the industry, management field and specific regulations applicable locally;

Currently holding the position of Head of Department or equivalent in the Department or equivalent position or title according to the regulations of the competent authority according to the decentralization of cadre management. In case of not holding a position, must have continuous working time in the industry or field for at least 7 years (excluding internship and probationary period).
