Continuing the meeting program between the 2 sessions of the 6th Session, on the afternoon of November 16, the National Assembly Standing Committee (NASC) gave opinions on the draft Law on Housing (amended).
Reporting on a number of major issues in explaining, accepting and revising the draft Law on Housing (amended), Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that on October 26, 2023, the National Assembly discussed the draft Law on Housing (amended) in the Hall.

Mr. Tung said that the draft Law has been absorbed and revised in major contents. Accordingly, Article 57 on multi-storey houses with many individual apartments (mini apartments) has been revised to overcome the shortcomings and limitations of the past, to strengthen strict management but still ensure to meet the needs of a part of the people for this type of housing;
Specifically, it does not stipulate specific requirements but refers the management conditions for this type of housing to the requirements for multi-storey, multi-apartment housing of individuals issued by the Minister of Construction, and the requirements of the law on fire prevention and fighting;
Decentralize to the provincial People's Committees the regulations on traffic routes for fire fighting vehicles to perform fire fighting tasks in places with multi-storey houses with many apartments of individuals; supplement regulations to adjust the types of multi-storey houses with many apartments that have mixed purposes of sale, lease-purchase, and rental to meet practical requirements.
The draft Law also stipulates that the Vietnam General Confederation of Labor is the governing body for investment projects to build social housing for workers and laborers who are eligible for social housing policies to rent.
Amend the regulations on incentives for investors of social housing projects at Point d, Clause 2, Article 85 in the direction of inheriting the provisions of the current housing law to supplement the right to build commercial housing within the land fund of 20% of the total residential land area within the project scope, but investors must pay land use fees for this area according to the provisions of the land law to both attract investment and strictly manage State budget revenue;
Regulations on construction of workers' accommodation in industrial zones; no regulations on workers' accommodation outside industrial zones;
Supplementing Clause 3, Article 95 on the investment project to build workers' accommodation in industrial parks must be approved by the Industrial Park Management Board in terms of investment policy and investor approval in accordance with the provisions of the law on investment to ensure consistency with the Investment Law; a number of other major policy contents have been agreed to be accepted and adjusted as shown in the draft Law.

Regarding a number of major issues requesting direction from the Standing Committee of the National Assembly, regarding public property housing (Article 13); management and use of public property housing, the Standing Committee of the Law Committee agreed with the drafting agency, proposing to revise Point d, Clause 1, Article 13 of the draft Law as follows: "Housing not falling under the cases specified in Points a, b and c of this Clause is invested in construction with State budget capital or has its origin from State budget capital or is established as the entire people's ownership according to the provisions of law in different periods and is being rented to households and individuals according to the provisions of the law on housing"; at the same time, synchronously revise this housing subject in the relevant articles of the draft Law.
Regarding the addition of subjects renting public housing, the Standing Committee of the Law Committee proposed to maintain the scope of subjects belonging to the people's armed forces and key organizations allowed to rent public housing as in Point d, Clause 1, Article 45 of the draft Law submitted by the Standing Committee of the National Assembly to the National Assembly at the discussion session in the Hall on October 26, 2023, specifically:
“Officers, professional soldiers, and non-commissioned officers of the people's armed forces are mobilized, rotated, or seconded according to national defense and security requirements; civil servants, workers, and national defense employees, and those doing cryptographic work and other work in cryptographic organizations receiving salaries from the State budget of the people's armed forces are mobilized, rotated, or seconded to work in communes in remote areas, areas with especially difficult socio-economic conditions, border areas, and islands; except in cases where the law stipulates that subjects under this point must stay in barracks of the people's armed forces.”
