Prime Minister: Law helps strengthen management but must encourage creativity

The Prime Minister requested that the law must design tools to enhance effective management, suitable to Vietnam's conditions, but must also create development and facilitate the effective use of resources.

On the morning of September 23, at the Government's special session on law-making in September 2024, Prime Minister Pham Minh Chinh requested to perfect institutions and laws to strengthen management, but must create for development, mobilize maximum resources and encourage creativity of people, businesses and related entities.

At the meeting, the Government discussed and gave opinions on the following contents: Draft Law on Data; Proposal to develop a Law on Personal Data Protection; Draft Law on amending and supplementing a number of articles of the Law on Health Insurance; Proposal to develop a Law on Lawyers (amended).

Government members said that the development and promulgation of laws aims to thoroughly grasp and concretize the Party's viewpoints, guidelines and policies on the above-mentioned fields; overcome shortcomings, inadequacies and limitations; serve state management, promote socio-economic development and ensure national defense, security, order and social safety in the coming time.

Regarding the Data Law Project, delegates enthusiastically discussed contents related to the concepts of data, connection, sharing, and authority; ensuring budget expenditure to implement the Data Strategy; the National Data Development Fund; connecting, sharing, and coordinating data; and the data exchange...

Regarding the Proposal to develop a Law on Personal Data Protection, Government members discussed in detail related policies: building, developing, managing, processing data, applying science and technology in data processing, state management of data; rights and obligations of data subjects; protecting personal data during data processing; conditions and measures to protect personal data...

In the Draft Law amending and supplementing a number of articles of the Law on Health Insurance, the Government considers contents related to health insurance participants, technical expertise lines, auditing, digital transformation applications, data sharing; registration for medical examination and treatment; referral to technical expertise lines; benefits of health insurance participants; improving the efficiency of health insurance fund management; criteria and principles for using the list of drugs used for medical examination and treatment for health insurance participants...

In the Proposal to develop the Law on Lawyers (amended), the Government agreed to comprehensively amend the 2006 Law on Lawyers to specify the 2013 Constitution on the rights of citizens to seek defense from lawyers; the Party's policies and guidelines on continuing to build and perfect the socialist rule of law state of Vietnam in the new period. In particular, it is agreed to develop the Law with the following policies: building a team of lawyers with political will, professional ethics and professional capacity; strongly developing the legal services market, at the same time building professional law practice organizations to meet the requirements of judicial reform and international integration; enhancing the self-management responsibility of socio-professional organizations of lawyers; the responsibility of organizations, strengthening state management of lawyers and law practice...

Directing on principles and requirements for law making, Prime Minister Pham Minh Chinh discussed and commented on each content of the draft laws and Proposals for law making; assigned Deputy Prime Ministers to direct ministries to preside over the drafting of draft laws and Proposals for law making to coordinate with the Ministry of Justice, the Government Office and relevant agencies to continue studying and absorbing opinions of Government members, meeting resolutions, and completing the draft law dossier according to the provisions of the Law on Promulgation of Legal Documents; promptly reporting to the Government and the Prime Minister on major issues in the process of coordinating to revise and complete the draft law.

Concluding the meeting, it was reported that at the 8th Session of the 15th National Assembly, the Government plans to submit 15 draft laws to the National Assembly for approval; submit 11 draft laws to the National Assembly for comments. According to Prime Minister Pham Minh Chinh, the task is very heavy, while there is very little time from now until the 8th Session. Therefore, the Prime Minister requested the Ministers and Heads of ministerial-level agencies to prioritize maximum time, effort, intelligence, concentrate the highest resources, directly lead and direct the completion of draft laws to submit to the National Assembly in accordance with the provisions of the Law on Promulgation of Legal Documents, ensuring quality and progress as required.

The Prime Minister requested ministries and branches to focus on perfecting laws, amending and supplementing regulations, in order to come up with breakthrough solutions to untie, remove bottlenecks, and unleash all resources for development.

During the law-making process, it is necessary to closely coordinate with the agencies of the National Assembly, create consensus in the process of examining, explaining, accepting, and revising the draft law according to the opinions of the National Assembly Standing Committee and National Assembly deputies; promptly report to the Government and the Prime Minister on arising issues and contents beyond the authority.

Prime Minister Pham Minh Chinh noted that the Party's guidelines and policies must be fully implemented in draft laws and ordinances. In law-making, it is necessary to start from practice, respect, closely follow and use practice as a measure; ensure feasibility, ensure national and ethnic interests; the legitimate rights and interests of individuals and organizations; promote decentralization and delegation of power thoroughly, while mobilizing and allocating resources effectively; design tools to strengthen supervision, inspection and control of power; cut down and simplify administrative procedures, minimize costs for people and businesses, improve the investment and business environment; eliminate the request-grant mechanism, and reduce intermediaries.

The Head of Government requested that the law must design tools to enhance effective management suitable to Vietnam's conditions, but must also create conditions for development and facilitate the mobilization and effective use of resources; encourage creativity of people, businesses and related entities; ensure legitimate and legal rights and interests and have tools to handle violations of people, businesses and related entities, on the perspective of not criminalizing civil and economic relations.

The Prime Minister requested to develop laws that inherit the regulations that are still suitable and have positive impacts in current laws; what is mature, clear, proven to be correct in practice, effectively implemented, and agreed by the majority should continue to be implemented and legalized; management must be open and clear about people, work, responsibilities, and results; maximize the opinions of experts, scientists, and related subjects; strengthen policy communication work, create social consensus in both the stages of building and perfecting laws and organizing law enforcement./.
