The Prime Minister requested to complete the draft laws in the direction of concretizing and institutionalizing the Party's policies; thoroughly decentralizing, delegating, and authorizing along with designing monitoring and inspection tools.
On the morning of April 18, concluding the second thematic Government meeting on law-making in April, Prime Minister Pham Minh Chinh requested to implement 6 principles in law-making and 6 principles in organizing, implementing and enforcing laws.
At the meeting, the Government reviewed and commented on five contents, including: Draft Law on amending and supplementing a number of articles of the Law on Planning; Draft Law on State Budget (amended); Draft Law on amending and supplementing a number of articles of the Law on Bidding, Law on Investment under the public-private partnership model, Law on Customs, Law on Export Tax, Import Tax, Law on Investment, Law on Public Investment, Law on Management and Use of Public Assets; Draft Law on amending and supplementing a number of articles of the Law on Enterprises; Draft Law on amending and supplementing the Law on Credit Institutions.
Regarding the Draft Law amending and supplementing a number of articles of the Law on Planning, Government members enthusiastically discussed the contents that need to be adjusted to suit the organizational arrangement of the political system and the arrangement of local administrative units, especially the contents that overlap between national planning, regional planning, provincial planning and sectoral and field planning; the issue of planning approval authority; the establishment of a planning appraisal council...
The Prime Minister directed the development of the Planning Law in the direction of ensuring that plans are built in harmony with nature, promoting the unique potential, outstanding opportunities, and competitive advantages of each unit; having a long-term vision, looking far and wide, thinking deeply, and doing big things; national planning must be done by the nation; provincial and regional planning must be based on national planning, provincial planning must be done by the province; there must be sectoral planning, done by the sector; there must be an appraisal organization, but responsibility must be individualized.
Delegates discussed the necessity, order, procedures and basic contents of the Draft Law amending and supplementing a number of articles of the Enterprise Law, especially the contents to remove and handle difficulties and shortcomings in the current Enterprise Law, as well as adjust the contents to comply with international provisions and regulations that Vietnam participates in.
The Prime Minister requested to complete the Draft Law, ensuring the reduction of administrative procedures; ensuring the freedom of business of enterprises; improving the investment and business environment; mobilizing all resources for investment and development; strengthening state management, but not creating new procedures.
In the draft of the State Budget Law (amended), the Government discussed the Law submitted by the Ministry with the abolition of 6 contents, completion of 14 contents and addition of 13 new contents, in order to perfect the legal policies related to state budget revenue and expenditure, in accordance with the new situation...
The Prime Minister requested that the law be designed to ensure stronger innovation, including closely following the direction and institutionalizing the Party's Resolution; increasing spending on development investment; eliminating the request-grant mechanism; increasing reserves; designing the authority of the National Assembly to decide on policy orientation, total expenditure, expenditure structure, and major national key projects; promoting decentralization; focusing on digitalizing budget revenue and expenditure; rewarding public and transparent budget expenditures...
Regarding the Draft Law amending and supplementing a number of articles of the Law on Bidding, the Law on Investment under the public-private partnership model, the Law on Customs, the Law on Export Tax and Import Tax, the Law on Investment, the Law on Public Investment, the Law on Management and Use of Public Assets, basically agreeing with the opinions of the delegates, the Prime Minister requested to amend the law, specify all relevant Resolutions of the Central Committee; amend a number of contents related to the above laws to be consistent with the arrangement of two-level local governments; continue to promote decentralization and delegation of power; handle obstacles and handle urgent issues to serve growth promotion...
Concluding the meeting, Prime Minister Pham Minh Chinh highly appreciated the efforts and active preparation of the ministries and agencies, and the submission of draft laws, resolutions, and the enthusiastic, responsible, practical, and quality comments of the Government members and delegates attending the meeting; requested the ministers and heads of sectors to focus on directing and promptly completing the dossiers of the draft laws in accordance with regulations to submit to the National Assembly at the 9th Session in May 2025.
The Prime Minister assigns Deputy Prime Ministers to directly direct the revision and completion of draft laws; assigns the Government Office to preside over and coordinate with relevant ministries and agencies to fully absorb the opinions of Government members and opinions at the Session; complete and promptly submit for promulgation the Resolution of the Special Session on Law-making to serve as a basis for ministries and agencies to study, absorb, complete and submit draft laws and resolutions.
The Prime Minister requested to complete the Draft Laws in the direction of: Specifying and institutionalizing the Party's policies; thoroughly decentralizing, delegating, and authorizing along with designing monitoring and inspection tools; allocating resources; minimizing administrative procedures; strengthening coordination between ministries and branches; investing efforts and intelligence in law-making; developing one law to amend many laws; ensuring "6 clarity" in the work of drafting Laws: "clear: omitted contents; amended and perfected contents; supplemented contents; contents of administrative procedure reduction and simplification; decentralization and delegation of powers; issues with different opinions and other issues that need to be reported to the Standing Government, the Government, and the Prime Minister for consideration and direction," while ensuring "6 clarity: clear people, clear work, clear time, clear responsibility, clear products, clear authority" in the process of organizing and implementing the law.
The Prime Minister requested that Ministers and Heads of ministerial-level agencies assigned to preside over the drafting of draft laws, ordinances and resolutions must directly direct the work of drafting and submitting draft laws, ordinances and resolutions; proactively coordinate with agencies of the National Assembly in submitting, receiving, completing and submitting draft laws, ordinances and resolutions; and report to competent authorities on arising issues.
The Prime Minister directed the Ministry of Justice to preside over and coordinate with relevant ministries and agencies to proactively review and prepare proposals for the development of laws, ordinances and resolutions for the 2026 Legislative Program; Organize a summary of the implementation of Conclusion No. 19-KL/TW of the Politburo on the orientation of law-making for the 15th National Assembly term, on that basis, study and propose the Legislative Orientation for the 16th National Assembly term./.
