DNVN - On the morning of June 28, the National Assembly passed the Capital Law (amended) with 462/470 delegates in favor. The Capital Law (amended) focuses resources and prioritizes the implementation of the zoning plan for the Red River and Duong River.
According to the Law on the Capital (amended), the planning of the Capital must ensure the construction of a civilized, modern, and sustainable capital. Ensure a clean living environment, secure water resources with the Red River as the green axis, central landscape, and harmonious urban development on both sides of the river of the city.
From there, ensure national defense, security, connect the technical infrastructure system, social infrastructure of the capital with localities that have activities of linking and developing the region with the capital and the whole country.
The Law on the Capital (amended) focuses resources and prioritizes the implementation of the zoning plan for the Red River and Duong River in accordance with the planning of the Capital and the general planning of the Capital. Accordingly, it allows the construction of new dikes in accordance with the flood prevention and control planning of the diked river, the dike planning and other related planning to effectively exploit land funds.
On the riverbank, some existing residential areas are allowed to exist and new constructions and houses are allowed to be built at appropriate proportions according to the flood prevention and control planning of the dike river and other related planning.
In addition, the remaining riverbank and floating areas are allowed to build works for public spaces and works serving public purposes, but the riverbank and floating areas must not be elevated to ensure that they do not obstruct the flow.
Previously, Chairman of the National Assembly's Law Committee Hoang Thanh Tung presented a report explaining, accepting and revising the draft Law on the Capital (amended). The draft law has been reviewed and revised in the direction of regulating the organizational structure and tasks and powers of the authorities at all levels in Hanoi city, not only in accordance with the provisions of the Law on the Capital but also the provisions of the Law on Organization of Local Government.
At the same time, supplement the authority of the Ward People's Committee in deciding on contents that, according to regulations in other legal documents, must be decided by the People's Council at the commune level or must be approved by the People's Council at the commune level before deciding or submitting to competent authorities for consideration and decision.
At the same time, along with regulations on decentralization and delegation of authority between levels of government of Hanoi city, the draft has added regulations on decentralization and delegation of authority of the Government, Prime Minister, Ministries and branches to agencies of Hanoi city to specify the policy of promoting decentralization and delegation of authority.
Based on the opinions of National Assembly deputies and the Government, the National Assembly Standing Committee has accepted and revised regulations on land management and use at river banks and floating banks on diked rivers, ensuring compliance with planning and requirements for flood prevention and control.
Regarding the policy for Hoa Lac High-Tech Park, the National Assembly Standing Committee has revised regulations related to the form of land allocation, land lease, authority to allocate land, land lease, and land management in Hoa Lac High-Tech Park. This is both consistent with reality and linked to the provisions of the 2024 Land Law, avoiding causing too much disruption in this field in Hoa Lac High-Tech Park.
