The $5 million "Yellow Card" and the Paths to the American Dream

(Dan Tri) - The immigration system in the US is relatively complicated, with many conditions for foreigners who wish to live permanently and become citizens in this country.

US President Donald Trump said on February 25 that he would end the EB-5 immigrant investor visa program that allows foreign investors to become permanent residents if they invest and create jobs in the US.

The program will be replaced by a gold card program that foreigners can buy for $5 million as a way to become U.S. citizens. The program could start in two weeks.

The White House boss's plan has caused a lot of debate around the world. However, this is not the only way for a foreigner to become an American.

Immigrating to the United States requires navigating a complex legal system that governs the flow of foreign nationals to settle in the United States. The main pathways to legal residency in the United States include family-based sponsorship, employment-based visas, the Diversity Visa Lottery, and refugee status.

Family sponsorship

Family reunification has long been a cornerstone of U.S. immigration policy. U.S. citizens and lawful permanent residents (green card holders) can sponsor certain family members to come to the United States.

Eligible groups include:

Immediate relatives: Spouse, unmarried children under 21 years of age, and parents of US citizens.

Family-Based Preferences: Adult children and siblings of U.S. citizens, as well as spouses and unmarried children of permanent residents.

The number of visas issued under this category is limited each year, resulting in long waiting times in some cases.

Employment and investment based visas

The United States offers a variety of employment-based immigrant visas to individuals with skills, education, or sponsorship from a U.S. business. These visas are divided into priority categories and are aimed at immigrating to the United States. Holders of these visas can apply for citizenship if they meet specific requirements.

EB-1: For individuals with extraordinary ability in the fields of science, arts, education, business or athletics; outstanding professors or researchers and executives of multinational corporations.

EB-2: For people with advanced degrees or extraordinary ability in the sciences, arts, or business. Some applicants can apply for a National Interest Waiver, which allows them to bypass the job offer requirement if their work would benefit the United States substantially.

EB-3: For skilled workers, professionals, and unskilled workers performing work that is not seasonal or temporary in nature.

EB-5: For immigrant investors who invest at least $1,050,000 (or $800,000 in high unemployment areas) in a new commercial enterprise and create at least 10 full-time jobs for U.S. workers. This program is intended to promote economic growth through foreign investment.

In 2025, a new visa initiative called the “golden card” was proposed, offering a path to US citizenship with a $5 million investment. The program is aimed at attracting wealthy individuals and is intended to replace the current EB-5 visa program.

There are also some temporary work visas in the US, such as OPT or H1-B, but these are not permanent residency visas. Holders of these visas will need to switch to another visa or a green card before they can apply for citizenship.

Diversity Visa Lottery

The Diversity Visa Program, established by the Immigration Act of 1990, is intended to encourage immigration from countries with low rates of immigration to the United States. Each fiscal year, approximately 50,000 visas are randomly issued to qualified individuals from approved countries. Successful applicants must meet certain educational or work experience requirements and undergo a rigorous screening process.
