Quang Nam Provincial Inspectorate holds dialogue to resolve complaints about resettlement land prices

Accordingly, authorized by her husband - Mr. Vo Vinh Quang, Ms. Nguyen Dinh Le Thuy (residing at No. 01, Lot C2, Apartment 319 Ly Thuong Kiet, Ward 15, District 11, Ho Chi Minh City) complained about Decision No. 448, dated April 25, 2024 of the People's Committee of Que Son district on approving specific land prices to calculate land use fees for resettlement areas (resettlement land prices) in residential areas and arranging resettlement in village 3, Huong An town (arranging resettlement for Ms. Le Thi Mieng (deceased), Mr. Quang's mother).

Ms. Nguyen Dinh Le Thuy said that the application of specific land prices to calculate land use fees (resettlement land) with the amount of 1.815 million VND/m2 is not in accordance with regulations and is not consistent with Decision No. 1793, dated December 20, 2013 of the People's Committee of Que Son district on approving the value of compensation, support and resettlement for Ms. Le Thi Mieng's household.

The complainant requested the People's Committee of Que Son district to calculate land use fees (resettlement land price) according to Decision No. 1793, dated December 20, 2013 of the People's Committee of Que Son district on approving compensation, support and resettlement values.

According to the records and opinions discussed at the dialogue, Ms. Le Thi Mieng's household had the entire plot of land No. 40, map sheet No. 33, area 4,060m2 (residential land + garden land) revoked to build infrastructure for Dong Que Son Industrial Park.

Ms. Le Thi Mieng filed a complaint requesting resettlement arrangement when the state reclaimed land. On April 23, 2019, the Chairman of Que Son District People's Committee issued Decision No. 398 on resolving the complaint with the content of not accepting the arrangement of 4 resettlement plots and calculating the compensation price difference for her household.

On April 25, 2019, Mr. Vo Vinh Quang (son of Ms. Le Thi Mieng) filed a second complaint, and the Chairman of the Provincial People's Committee issued Decision No. 1865, dated July 13, 2020, regarding the settlement of Mr. Vo Vinh Quang's complaint. Accordingly, the complaint content regarding the allocation of 4 resettlement land lots was accepted.

To implement this decision, on December 21, 2023, the Project Management Board - Que Son District Land Fund coordinated with the People's Committee of Huong An town and Ms. Nguyen Dinh Le Thuy to organize a draw and agree on 4 resettlement land lots that were drawn.

Regarding the determination of specific land price approval to calculate land use fees in the Residential and Resettlement Area in Village 3, Huong An Town for Mr. Vo Vinh Quang's household, Ms. Thuy did not agree with the land price of 1.815 million VND/ m2 in Decision 448 dated April 25, 2024 of the People's Committee of Que Son District. And there was a complaint from the competent authority requesting the People's Committee of Que Son District to calculate land use fees (resettlement land price) according to Decision No. 1793, dated December 20, 2013.

The case was resolved by the Chairman of Que Son District People's Committee in Decision No. 884 dated July 17, 2024, but Ms. Nguyen Dinh Le Thuy did not agree. On August 15, 2024, the Chairman of the Provincial People's Committee issued Decision No. 1917 assigning the Provincial Inspectorate to verify and clarify the content of Ms. Nguyen Dinh Le Thuy's complaint, organize a dialogue before advising on the issuance of a decision to resolve the second complaint in accordance with regulations.

Based on the verification report of the Provincial Inspectorate, the content stated by Ms. Nguyen Dinh Le Thuy, representatives of relevant departments of the province discussed and analyzed the legal basis related to the implementation of compensation, support and resettlement policies of the People's Committee of Que Son district; difficulties and limitations in the process of implementing the policy leading to citizens' complaints; results of the first complaint settlement. Especially the basis for considering the request for land use fee calculation (resettlement land price) according to Decision No. 1793, dated December 20, 2013 of the complainant and proposed to submit for consensus opinions of the Provincial Land Advisory Council.

Agreeing with the views of representatives of specialized sectors, Chief Inspector of the province Nguyen Duc Tien assigned the Verification Team of the provincial Inspectorate to work with the People's Committee of Que Son district to carefully review the issue related to the calculation of resettlement land prices of Ms. Thuy and similar households affected by the Dong Que Son Industrial Park project.

On that basis, supplement and complete the verification report and invite the Provincial Land Advisory Council to meet to give comments. When the results of the Advisory Council meeting are available, if there are any remaining issues, please consult the Provincial People's Committee. After that, if you do not agree with the results of the second complaint settlement of the Provincial People's Committee, Ms. Nguyen Dinh Le Thuy has the right to file a lawsuit in court to protect her rights according to the law.
