Focus resources on reforming wage policy

The National Assembly requested the Government to focus resources on reforming wage policies and report on the implementation roadmap at the 6th session at the end of 2023.

The resolution of the 5th session passed by the National Assembly on the afternoon of June 24 assigned the Government to find solutions to stabilize employment for workers; provide timely support for unemployed and jobless workers; build social housing, and build and improve the effectiveness of cultural institutions for workers in industrial parks and export processing zones.

Agencies must enhance the responsibility of their leaders, promptly and effectively overcome the situation of shirking, evasion, and lack of responsibility among some cadres and civil servants, and strictly handle violations. The Government should soon propose or promulgate specific regulations on mechanisms to encourage and protect cadres who dare to think, dare to do, and dare to take responsibility for the common good.

The Government is assigned to focus on preserving and promoting the nation's fine cultural heritage values; synchronously developing cultural and social fields; building a healthy lifestyle; preventing moral and lifestyle degradation; preventing domestic and school violence and child abuse; and implementing good policies for people with meritorious services.

The National Assembly requested an assessment of the current situation to arrange teachers to teach new subjects appropriately; effectively handle shortcomings in textbooks, surplus and shortage of teachers, schools and classrooms; prioritize budget investment in facilities, purchase of teaching equipment, and ensure conditions for innovation in teaching methods according to the 2018 general education program.

In mid-June, Ms. Nguyen Bich Thu, Acting Director of the Wage Department (Ministry of Home Affairs) said that she was preparing a report on the salary reform roadmap according to Resolution 27 of the Central Committee to seek opinions from the State Wage Steering Committee. In the coming time, the State Wage Reform Steering Committee will meet to give opinions to report to competent authorities.

Resolution 27 of the Central Committee aims to reform the salaries of cadres, civil servants, public employees, armed forces and employees in enterprises from July 1, 2021. However, over the past two years, due to many adverse impacts from within the country and the world, especially the outbreak of the Covid-19 pandemic, socio-economic development and state budget revenue have been affected. Therefore, the roadmap for synchronous reform of salary policy has not been implemented.

According to the 2004 Decree, civil servant and public employee salaries are calculated by multiplying the basic salary by the salary coefficient. With the current basic salary of 1.49 million VND, the highest salary of a civil servant (type A1, group 1, level 6) is 11.92 million VND/month; the lowest (type C, group 3, level 1) is 2.01 million VND/month.

From July 1, when the basic salary increases to 1.8 million VND, the highest salary for civil servants is 14.4 million VND/month; the lowest is 2.43 million VND/month. Meanwhile, the monthly regional minimum wage applied to employees at enterprises in region 1 is 4.68 million VND; region 2 is 4.16 million VND; region 3 is 3.64 million VND; region 4 is 3.25 million VND.

Resolve the issue of business owners being wrongly charged insurance in 2023

The resolution on questioning activities at the 5th session was passed by the National Assembly on the afternoon of June 24, requiring the Government and agencies in 2023 to review, fully compile statistics, and thoroughly resolve problems with the number of individual business owners who have participated in compulsory social insurance.

Agencies must proactively review to promptly detect, propose solutions to handle and resolve other arising cases not regulated by the law on social insurance; strengthen inspection, examination and strictly handle violations of the law on social insurance and unemployment insurance.

The National Assembly requested to improve social insurance policies to expand and encourage workers and businesses to participate, aiming for the goal of universal social insurance; to overcome slow and evasive social insurance payments and other fraudulent and profiteering behaviors; to limit the situation of withdrawing social insurance at one time. By 2025, the whole country strives for 45% of workers to participate in social insurance; 35% of workers to participate in unemployment insurance.

By September 2016, 4,240 individual business owners in 54 localities paid compulsory social insurance, even though they were not required to pay according to regulations. There was a case where they paid for 20 years but were not eligible for pension, so they filed a lawsuit against the social insurance agency in court.

Vietnam Social Security said that since 2003, some eligible household owners have received pension and one-time social insurance benefits. However, many cases have not been counted for payment period and have not received benefits due to inconsistent awareness of business households participating in social insurance. Therefore, in 2016, Vietnam Social Security requested localities to stop collecting compulsory social insurance for individual business owners, and at the same time reported to the Ministry of Labor, War Invalids and Social Affairs for solutions to ensure the rights of contributors.

Assessing that "the withdrawal of social insurance from business owners will be very complicated because they do not agree, affecting their rights", Vietnam Social Security proposed a policy to include individual business owners in the compulsory social insurance payment category and allow the calculation of the payment period so that they can enjoy the regime according to the payment - benefit principle.
