Creating conditions for the development of cultural industrial centers in the capital

Hanoi is focusing on developing new creations with a focus on developing the Cultural Industry Center. Currently, a draft Resolution on the organization and operation of the center is being widely consulted by people and all walks of life in the community.

Implementing Clause 7, Article 21 of the Capital Law 2024 promises to open up a new space for the cultural industry sector, contributing to the economic and social development of the Capital. This will be a comprehensive legal framework for the establishment, management and operation of cultural industry centers, where traditional cultural heritage and modern technology are connected to create valuable cultural products and services.

The draft Resolution regulating the organization and operation of cultural industry centers consists of 5 chapters and 24 articles. In particular, a cultural industry center is defined as "an area with a defined geographical boundary, specializing in activities in the field of cultural industry". These centers can be established according to three organizational models: Enterprises, public service units or cooperatives.

The draft resolution clearly stipulates the authority to establish cultural industry centers, planning of cultural industry centers, organization of activities of cultural industry centers, etc.

Specifically, the cultural industry center operates according to the principles of compliance with the laws and regulations of Hanoi city; ensuring sustainable development, combining the preservation and promotion of traditional cultural values ​​with innovation.

One of the important highlights in the draft Resolution is the preferential policies and support for the development of cultural industries, especially the priority in planning, infrastructure investment, as well as resource support for new investment projects in the cultural industry.

The city prioritizes planning and land allocation; prioritizes investment in building cultural industrial infrastructure; mobilizes resources to implement cultural industrial development projects to assign or lease to cultural industrial centers; prioritizes consideration of converting the functions of public property works into new cultural creative spaces to develop cultural industrial centers.

Cultural industrial centers, organizations and individuals producing and doing business in cultural industrial centers enjoy preferential policies for new investment projects in cultural industries as prescribed in Point a, Clause 1, Clause 2, Article 43 of the Law on the Capital; are considered for exemption or reduction of land rent as prescribed by law on policies to encourage socialization.

In case of renting public property to establish a cultural industrial center as prescribed in Articles 10 and 11 of this Resolution, the investor preparing a proposal to rent public property to use as a cultural industrial center must prepare documents proving the investor's financial capacity.

The rental price of the building is determined based on the calculation of all costs of forming the leased asset, compensation for maintenance and repair costs of the building and land rent according to regulations, taking into account the incentive factor for the cultural industrial center at the time of signing the lease contract and other long-term benefits.

The term of the construction lease is determined by agreement between the agencies and may exceed 10 years. The starting point of the lease term is the date of signing the construction lease contract.

The draft resolution also emphasizes supporting creative startups through funding programs and business incubators, as well as encouraging public-private partnerships in developing cultural industries. This is an important policy to help creative initiatives have the opportunity to be realized and develop sustainably…

In addition, the Draft Resolution also clarifies the activities of the cultural industry center, including the following contents: Consulting services, support for creation and production of cultural products and services; support services for distribution and consumption of cultural products and services; organization of spaces for displaying, introducing and selling cultural products; Trade promotion and promotion of domestic and foreign cultural products; provision of infrastructure and facilities services; services for organizing display, performance, exhibition and other cultural events; training, fostering and developing human resources; activities to support cooperation and development; activities to support start-ups and innovation; activities to support protection of intellectual property rights; international cooperation activities on cultural industries, etc.

Currently, Hanoi city is widely publicizing the draft Resolution regulating the organization and operation of cultural industry centers to collect opinions from organizations and individuals to complete and submit to the City People's Council for consideration and approval.

It is expected that after being passed, this Resolution will create a new wave in the development of cultural industry in the Capital, contributing to the goal of building Hanoi into a "Creative City", while making culture a spearhead economic sector, bringing high economic value and contributing to promoting the image of the Capital.
