Commenting on the draft law, delegate Trieu Thi Ngoc Diem (Soc Trang) emphasized that amending and supplementing the Law on Technical Standards and Regulations 2006 is not only an immediate task but also a long-term strategy to improve the quality of state management and sustainable socio-economic development.
The draft Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations 2006 demonstrates a great effort in perfecting the legal framework on standardization, ensuring compliance with commitments in the new generation Free Trade Agreement (FTA), and meeting objective requirements of practice.
Therefore, delegates expressed high agreement with the need to amend the law and basically agreed with the draft law presented at the session.
Regarding the feasibility of the national database system, delegates highly agreed on adding content in Article 8c on the national database system on technical standards and regulations and a number of other provisions in the draft related to this content, emphasizing that the construction of a national database system on technical standards and regulations will bring many benefits to businesses and state management agencies such as saving costs for searching for information, or increasing transparency and reliability of products on the market.
Delegates proposed to pay attention to and clarify the implementation roadmap, time to complete the trial operation and specific responsibilities of each agency, data sharing mechanism between agencies and the ability to link with international databases, as well as funding sources for building and maintaining the system.
In addition, it is necessary to clarify support policies for businesses participating in system construction, for example, exempting, reducing or reducing fees for businesses and organizations when accessing and using data on the system, especially for small and medium enterprises or non-profit research organizations...
Highly appreciating the draft, delegate Pham Van Thinh (Bac Giang) emphasized that a country's technical standards and regulations are very important and play a decisive role in the quality of products created by that country. In forming national competitiveness, standards and regulations also play an important role as infrastructure.
However, the delegate also said that although management agencies have regularly revised and supplemented many standards and regulations, the current status of standards and regulations in our country still has shortcomings.
Currently, we have about 13,000 national standards and 800 regulations. The application of regulations is mandatory, while standards are voluntary, but in reality, when implementing most activities, competent authorities stipulate mandatory compliance with standards, especially for construction activities.
Delegate analysis, design standard There may be a tendency to build too much detail, too much redundancy, mainly paying attention to implementation procedures without prioritizing quality control at the end of each stage, leading to a loss of creativity, increased compliance costs, and possibly becoming outdated when the technology of materials used has changed or when there are product standards that are more suitable to practice and have higher economic efficiency but are slow to be issued for application.
To improve this sustainably, delegate Thinh emphasized, the only way is to promote the role of the people and rely on the people.
Therefore, the delegate suggested that the law should add a provision regulating the mechanism for promoting initiatives to improve standards, regulations and the monitoring mechanism of the community and the National Assembly; the accountability of the issuing agency to ensure that national standards and national regulations are always improved in a direction consistent with international integration, easy to implement, optimal compliance costs, and have creative space to promote the application of new technologies, techniques and materials in implementing standards and regulations.
The content of initiatives, supervision and explanation must be made public and fully recorded in the digital environment and the Government is responsible for specifying the details of this article.
There needs to be a monitoring mechanism to reduce compliance costs for people and businesses.
On behalf of the drafting agency, Minister of Science and Technology Huynh Thanh Dat explained and clarified a number of issues raised by National Assembly deputies.
The Minister affirmed that there is no overlap between Law on Technical Standards and Regulations with other specialized laws on conformity declaration procedures.
Regarding the proposal to abolish the procedure for declaring conformity, the Minister said that this is no different from Vietnam abolishing technical standards. On the other hand, abolishing the procedure for declaring conformity will go against international practices and international commitments; at the same time, it will cause risks and insecurity when there are products and goods that do not have any quality management measures other than technical standards.
Regarding the application of basic standards in specialized fields, the Minister said that if the scope of application of basic standards of state agencies is expanded, it may lead to arbitrary application, group interests, causing difficulties for production and business activities of enterprises. The Ministry of Science and Technology will continue to study and clarify this regulation.
Explaining the delegates' opinions on enterprises assessing conformity based on the results of conformity assessment and standards, the Minister agreed with the delegates' opinions to add a post-inspection mechanism for the risk level of the product.
The Minister also accepted the delegates' opinions on supplementing regulations on impact assessment reports of standards to ensure the feasibility of standards, in addition to studying and supplementing the encouragement of initiatives to improve standards and regulations.
