Strengthening management of goods origin |
Directive 09/CT-BCT aims to promote balanced and sustainable trade, ensuring harmonious interests between Vietnam and partners that have signed Free Trade Agreements (FTAs), while complying with international commitments.
The Import-Export Department is assigned to preside over and coordinate with the Legal Department to research and advise on amending and supplementing legal documents related to the origin of goods, in accordance with the Law on Organization of the Government and the Law on Organization of Local Governments in 2025. These amendments aim to ensure the smooth issuance of Certificates of Origin (C/O), avoid interruptions, and create favorable conditions for businesses.
At the same time, the Import-Export Department coordinates with the Customs Department under the Ministry of Finance to strengthen the supervision and inspection of origin, especially for imported raw materials used for export production, through the construction of an information network and specialized data system. C/O issuing agencies are required to improve the efficiency of inspection and verification of origin criteria according to specific rules of goods, propose measures to prevent illegal transshipment, and protect the reputation of Vietnamese goods.
The Legal Department is responsible for reviewing current legal documents, proposing a mechanism for granting C/O suitable to the new situation, and closely coordinating with relevant units to promptly handle violations of origin.
The Trade Defense Department continues to carry out the tasks assigned under Decision No. 824/QD-TTg in 2019, focusing on combating trade defense evasion and origin fraud, according to the action plan of the Ministry of Industry and Trade.
Directive 09/CT-BCT also emphasizes reforming administrative procedures and applying digital transformation in the management of goods origin. The Department of E-commerce and Digital Economy is tasked with upgrading the eCoSys system, perfecting features to effectively implement the issuance of non-preferential C/O, and adding data processing capabilities for review, inspection and verification. This system will digitize statistical data of enterprises requesting the issuance of C/O, helping to simplify the process, save costs and increase transparency.
At the same time, the Import-Export Department coordinates with relevant units to propose solutions to simplify administrative procedures in a civilized and modern manner, ensuring that businesses are best served. C/O issuing agencies are required to step up the prevention of origin fraud by increasing inspections before and after issuing C/O, especially for businesses with a sudden increase in the number of applications. Inspections at production facilities are carried out in accordance with Circular No. 39/2018/TT-BCT, ensuring compliance with regulations and enhancing the reputation of exported goods.
The Department of Foreign Market Development is responsible for directing Vietnamese Trade Offices abroad to study the regulations of origin of host countries, providing information to the Import-Export Department to perfect the rules of origin and prevent fraud. The Department of Domestic Market Management and Development coordinates with the Department of Industry and Trade of provinces and cities to inspect and monitor the market, strictly handling acts of trading in smuggled raw materials or goods of unknown origin for export production. The Department of Multilateral Trade Policy actively exchanges with FTA partners to resolve problems of origin, protecting the legitimate rights of Vietnamese enterprises. These efforts not only reduce administrative burdens but also create a favorable business environment, helping enterprises restructure production to meet international standards.
