Amending regulations on management and operation of the Natural Disaster Prevention and Control Fund

Kinhtedothi - The Government issued Decree No. 63/2025/ND-CP amending and supplementing a number of articles of Decree No. 78/2021/ND-CP dated August 1, 2021 of the Government on the establishment and management of the Natural Disaster Prevention and Control Fund.


The Central Disaster Prevention and Control Fund is established and managed by the Ministry of Agriculture and Environment.

According to the new regulations in Decree No. 63/2025/ND-CP, the Central Disaster Prevention and Control Fund (hereinafter referred to as the Central Fund) is established and managed by the Ministry of Agriculture and Rural Development (now the Ministry of Agriculture and Environment).

In Decree No. 63/2025/ND-CP, the regulations on the management and operation apparatus of the Central Fund are amended as follows:

The Ministry of Agriculture and Environment uses the apparatus of the specialized agency advising the Ministry of Agriculture and Environment on state management of natural disaster prevention and control as the agency managing the Central Fund.

The Central Fund Management Agency includes the Director, Deputy Directors, Chief Accountant, civil servants and public employees working part-time or on secondment.

The Director of the Central Fund is decided by the Minister of Agriculture and Environment. The Director of the Central Fund is the legal representative of the Central Fund; is authorized to sign contracts in accordance with the provisions of law for a number of tasks serving the operation of the fund, and is responsible before the law and the Minister of Agriculture and Environment.

The Deputy Directors of the Central Fund are decided by the Minister of Agriculture and Environment upon the proposal of the Director of the Central Fund.

Chief accountant, civil servants, public employees holding concurrent positions or being seconded at the Central Fund management agency shall be decided by the Director of the Central Fund in accordance with the provisions of law.

The working regime, tasks and powers of the Central Fund management agency are stipulated in the Regulations on organization and operation of the Central Fund issued by the Minister of Agriculture and Environment at the request of the Central Fund management agency.

Provincial Fund Management and Operational Apparatus

Regarding the management and operation apparatus of the Provincial Disaster Prevention and Control Fund, according to Decree No. 78/2021/ND-CP, the Chairman of the Provincial People's Committee decides to establish a Provincial Fund, including: Management Board, Control Board and Provincial Fund management agency.

This regulation is amended by Decree No. 63/2025/ND-CP as follows: The Chairman of the Provincial People's Committee decides to establish a Provincial Fund; uses the apparatus of the specialized agency advising and assisting the Provincial People's Committee in state management of natural disaster prevention and control as the agency managing the Provincial Fund.

The provincial Fund management agency includes the Director, Deputy Directors, Chief Accountant, civil servants and public employees working part-time or on secondment.

The Director of the Provincial Fund is decided by the Chairman of the Provincial People's Committee. The Director of the Provincial Fund is the legal representative of the Provincial Fund; is authorized to sign contracts in accordance with the provisions of law for a number of tasks serving the operation of the fund, and is responsible before the law and the Chairman of the Provincial People's Committee.

The Deputy Directors of the Provincial Fund are decided by the Chairman of the Provincial People's Committee upon the proposal of the Director of the Provincial Fund.

Chief accountant, civil servant, public employee holding concurrent positions or being seconded at the provincial Fund management agency shall be decided by the Fund Director in accordance with the provisions of law.

The working regime, tasks and powers of the provincial Fund management agency are stipulated in the Regulations on organization and operation of the provincial Fund issued by the Chairman of the provincial People's Committee at the request of the provincial Fund management agency.

The provincial People's Committee assigns the district and commune People's Committees to organize the collection and payment of funds according to regulations.

Decree 63/2025/ND-CP takes effect from April 19, 2025. The Ministry of Agriculture and Environment shall complete the management and operation apparatus of the Central Fund; the Provincial People's Committee shall complete the management and operation apparatus of the Provincial Fund according to the provisions of this Decree no later than 45 days from the effective date of this Decree.
